VCN- The Anti-Smuggling Investigation Department (The General Department of Customs) has written advising the Supreme People’s Procuracyabout a proposal to prosecute the case of smuggling for 2 individuals forillegally exporting nearly 50 tons of copper.

On March 23rd, 2016, Ms Huynh Thuy Le, born in 1980 (located at 38/22D BuuDinh, Ward 5, District 6, Ho Chi Minh City) opened anon-commercial export declaration No. 971600538070 at the Saigon port Customs Sub-Department, Area 4.

The declared goods were the axles of steel rolling-mills, the goods were used andoriginated in Vietnam, export tax of 0%, worth of $US 11,550.

However, the examination results of the Anti-smuggling Control Team in the Southern region (Team 3) and the assessment results showed that the actual goods were copper scrap of all types, volumes were 26.25 tons.

According to the valuation report of violation exhibits of Team 3 dated July 14th, 2016, the copper scrap was worth 1.575 billion vnd.

Also on March 23rd, 2016,Mr Ly Quoc Hung (born 1978, address: A34/12 Hamlet 1, National Highway 50, Binh Hung Commune, BinhChanh district, Ho Chi Minh City) opened a non-commercial export declaration No 971600537690 at the Saigon port Customs Sub-Department Area 4.

The declared goods wereremovable industrial shelves made from iron, originated in Vietnam, export tax rate of 0%; worth of $US 21,600.

According to the results of examination and assessment collected by Team 3, the actual goods werecopper scrap of all types, volume was22.71 tons (without Customs declaration).

According to the valuation report of violation exhibits of Team 3, 22.71 tons of above violation copper were worth 1,326 billion vnd.

Based on the detection and assessment results of Team 3, MsLe Thuy Huynh and MrNguyen Quoc Hung had fraudulent actsin Customs declaration (declarationswere the axles of steel rolling-mills and industrial iron shelves, tax rates of 0%, in order to export illegally scrap copper, worth of violation goods were 2.9 billion vnd).

These violation cases had signs of smuggling under the provisions of Article 153 of the Criminal Code.

The Customs forces continued to verify expansively and discovered that during the period January 1st, 2016 to March 23rd, 2016, Nguyen Thi Huynh and Ly Quoc Hung registered 21 declarations in their names, according to the declaration, goods were the steel rolling-mills and industrial iron shelves, the tax rate of 0%.

However, the results of the verification at the shipping companies, and information onthe bill of lading of the above export consignments showedthat the goods were mixed copper scrap, the senders were: Brain Logistics Joint Stock Company, the shipping companies delivered VAT invoices for Intellectual Logistics JSC.
