Amending Decree on warehousing conditions towards the modernization

VCN- On 12th September 2018, Deputy Minister of Finance Vu Thi Mai chaired an online meeting with local Customs departments to complete the draft decree amending and supplementing a number of articles of the Government’s Decree 68/2016/ND-CP regulating conditions for duty-free business, warehouses, sites for customs clearance, customs inspection and supervision.

The meeting

The Deputy Minister Vu Thi Mai emphasized that the amendment and supplementation of Decree 68/2016/NĐ-CP must remove current shortcomings, ensure the goal of reform, modernization and standardization in Customs management and inspection. At the same time, the revised contents must facilitate the business.

“The prevention of establishment of many warehouse and yards leads to the discrete operation of warehouses and yards, which causes difficulty for Customs supervision. Thus, the issue is that the amendment must be in line with reality,” Deputy Minister emphasized.

On the basis of the orientation of the Deputy Minister, the representatives of some units under the Ministry of Finance, the General Department of Vietnam Customs and Customs departments in provinces and cities commented on articles and clauses in the Draft Decree.

For example, the representative of Quang Ninh Customs Department proposed to specify that if bonded warehouses were recognized, but enterprises do not operate within certain period of time, their operation must be terminated.

Because, although they do not operate their business, the Customs authority still has to arrange officers to control, inspect and supervise, which is time-consuming, consumes human resources, and is potentially risky.

For the conditions for recognizing the sites for gathering, inspection and supervision for imported and exported goods in the border gate areas, the representative of Lao Cai Customs Department said that the condition for areas at land border gates needs to be calculated precisely, because the land fund in these areas is not much.

Besides the above comments, there were many comments from customs departments on other issues, including: conditions for recognizing bonded warehouses, dossier for recognition bonded warehouses, cases of temporary cessation of bonded warehouse; dossier for recognition of site for gathering bulk cargo; conditions for recognition of sites for carrying out Customs procedures at import and export ports established in the inland areas; sites for collection, centralized inspection and supervision for post and express delivery goods; Conditions for recognition of warehouse, yard and site for inspection and supervision of import and export goods in seaports, inland waterway ports, international airports, international railway stations.

For the comments by units, Deputy Minister Vu Thi Mai requested the drafting committee to receive them, and submit a revised Draft Decree to the Ministry of Finance soon.

The Deputy Minister emphasized that the draft Decree was developed in the context of the Government's direction to reduce business conditions to facilitate businesses and people. Therefore, the amendment should be in line with the Government’s instruction and towards the goal of modern customs management.
