Chemical declaration must be done when importing pharmaceutical raw materials

During the management process of imported chemical commodities, some local departments have reported on the difficulty related to the requirement to present a “Certificate of chemical declaration” licensed by the Ministry of Industry and Trade for pharmaceutical raw materials.
Under the provisions of Clause 11, Decree No.26/2011/ND-CP detailing and guiding the implementation of a number of articles of Chemical Law “before enjoying Customs clearance for chemicals, organizations and individuals importing chemicals are responsible for completing a declaration of chemicals with the Ministry of Industry and Trade”. However, it has not guided in detail the case of imported pharmaceutical raw materials licenced by the Pharmacy Management Department - Ministry of Health, if those chemicals must be declared to the Ministry of Industry and Trade or not.
The General Department of Customs has discussed with the Chemical Department (the Ministry of Industry and Trade) which is the specialized management agency for this item to guide local Customs Departments for uniform implementation. Based on the report of the Chemical Department, the General Department of Customs will guide specifically for chemical declaration procedures for imported pharmaceutical raw materials
Specifically, enterprises still need to declare chemicals with the Ministry of Industry and Trade in the case of imported goods under Annex V of Government Decree No.26/2011/ND-CP amending and supplementing a number of articles of Government Decree No.108/2008/ND-CP.
When importing chemical commodities, enterprises must declare the chemicals with the Ministry of Industry and Trade and submit an original certificate of declaration which has been issued by the Ministry for Customs authorities to manage import procedures.
