Circular on instructing submission time of C/O in the EVFTA will be issued soon

The important content in the draft circular that is being collected opinion is about submission time of certificate of origin.
Specifically, in Article 3 of the draft circular is formulating toward the direction as: “Customs declarant submits proof of origin at the time of implementing customs procedure as prescribed in Article 7 of Circular 38/2018/TT -BTC dated April 20, 2018 of the Minister of Finance regulating determination of origin of exported and imported goods.
“If proof of origin is not available when implementing customs procedures to apply special preferential tariff rates, customs declarants must declare late submission of proof of origin on the import customs declaration and make additional declarations and submit proof of origin of goods within two years since the date of registration of customs declarations.
“Other contents on inspection and determination of the origin of goods will comply with current law".
To ensure the content specified in the draft circular is consistent with current regulations and meets State management requirements for verification of origin of goods and appropriate with international commitments, the General Department of Vietnam Customs is widely collecting opinions of related units and business associations.
