Customs authority is prosecuting the smuggling case of Euro Auto

Specifically, on December 20, 2016, the Department of Anti-Smuggling and Investigation (General Department of Customs) issued Decision 18 / QD-DTCBL to prosecute the smuggling case occurred at Euro Auto.
The decision was made on the basis of the results from the investigation and verification and the evidences collected and agreement with the Supreme People's Procuracy on the import of BMW automobiles against the Customs laws of the Euro Auto Joint Stock Company.
Earlier, on November 30, 2016, the Ministry of Finance issued Official Letter 17041 / BTC-VP to the General Department of Customs on the prevention of smuggling and trade fraud for the import of automobiles.
Through the management, examination and inspection of the prevention and fight against smuggling and trade fraud for the import of CBU automobiles of Euro Auto Joint Stock Company (Nguyen Van Linh street, Tan Phu Ward, District 7, Ho Chi Minh City) the Ministry of Finance has identified 3 big violations, including:
The company arbitrarily consume goods (imported BMW cars) without the Customs clearance during the time of self-preservation waiting for completion of Customs clearance as prescribed.
The Company did not provide Certificates of origin (C/O) and documents related to the BMW automobiles due to the importing company having signs of cheating customers
The Company used fake documents such as sales contract, commercial invoices to import BMV cars
According to the Customs Law, Law on Tax administration and other related document, also to ensure a healthy business environment in the spirit of implementing the Government Resolution No. 35 / ND-CP on supporting and developing enterprises by 2020 and to prevent acts of smuggling, trade fraud, tax evasion, as well as ensure the benefits of consumers, the Ministry of Finance requested the General Department of Customs to temporarily stop the Customs clearance for shipments of imported BMW cars (except privileged subjects and diplomatic immunity)
The Ministry of Finance also asked the General Department of Customs to work concretely with the Supreme People's Procuracy to consider for prosecution for the violations the Euro Auto Joint Stock Company as regulated.
On April 27, 2017, talking with a Customsnews correspondent, a leader of the Anti-Smuggling and Investigation Department said that after issuing the decision to prosecute the criminal case, the Department transferred the case’s dossier (At the end of December, 2016) to the Investigation Police Agency (the Ministry of Public) for further investigation as prescribed.
"After transferring the case’s dossier to the Investigation Police Agency, the Customs Authority will continue to collaborate with the Public Authority in the processing of the case,” added by the leader of the Anti-Smuggling and Investigation Department.
Regarding to the information on prosecuting and detaining some staff of the Euro Auto JSC, the leader of the Anti-Smuggling and Investigation Department stated that until early afternoon of April 27, 2017, the Department has not received official information from the police about the detention. |
