This Circular amends and supplements the content of management of charges and fees in the field of exit, entry, transit and residence in Vietnam.
Specifically, the fee-collecting agencies as the Immigration Department (Ministry of Public Security), the Police Department, the Border Guard Command of the provinces and centrally-run citieswill be allowed to deduct 20% of the collected fee amount to cover expenses prescribed in Article 5 of Decree 120/2016 / ND-CP guiding the implementation of a number of articles of the Law on Fees and Charges.
This deduction rate is currently 30% of the collected fee amount. Thus, under the new regulation, it decreases by 10%.
This means that the fee-collecting agencies remit 80% of the total collected fee amount to the state budget.
A new point mentioned in the circular is that the deducted amount of 20% in addition to the expenses related to the work performance, services and fee collection will be used to support the purchase of airline tickets, accommodation, hiring of interpreters and keeping of foreigners detained; medical examination and treatment when foreigners are ill; escorting foreigners who illegally reside and violate the law to their home countries; to trainand raise the qualifications and knowledge for officials and soldiers in charge of immigration management; to apply modern advanced science and technology for immigration management; to serve negotiation and cooperation with foreign partners for issuance of visa and documents related to Vietnam 's entry and exit for foreigners.
In addition, this deducted amount can also be used to supplement incomes and improve the lives of officials and soldiers in charge of immigration management according to the provisions of law (if any).
Circular 41 officially takes effect from August 1, 2020.
