VCN -  The Ministry of Finance has finished a draft circular which guides some content of Decree no 04/2019/NĐ-CP about standards and norms of using a car. This draft assigns clearly that the expenditure allocation for using a car depends on each stage of use.

Vehicle management company defines distance

The draft assigns expenditure allocation for using a car depends on each stage of use. Specifically, the funds for using a car with pick up from home to company and in the opposite direction, is defined in 2 forms as the expenditure allocation paid by the actual km, and the expenditure allocation is paid by package.

If the defined method is to be paid by actual km, expenditure allocation per month equals the number of kilometers from the residence to the company multiplied by 2, then multiply actual working days and multiply unit price. Include: The number of kilometers from the residence to the agency is the shortest actual distance from the whereabouts to the agency and vice versa of the titled person; Two times includes arrival and departure on a working day; the actual working days in a month is the factual number of days that the employee works at the company

If the choice is an expenditure allocation paid by package, the allocation equals the average number of kilometers from the place of residence to the company multiplied by 2, then multiply the average number of days of transportation per month with contract price. Include: The average number of kilometers from the residence to the company that a car is used, and calculated according to the total actual shortest kilometers from the titles’ residences to the company divided by total number of titles under the contractual object; 2 times including 1 arrival and 1 return on a working day; Average number of shuttle days (day / month).

With business trips, the authorized company or person can decide to allocate expenditure for using car by allocating the whole working trip, or for each step of a trip (for example, allocating when having business trip within provinces and cities directly under the central government, and a business trip in a district area).

The expenditure allocation for business trips is also determined by two forms. First, expenditure allocation depends on the actual km on a business trip equal to the actual number of kilometers of each business trip multiplied by the unit price. Second, expenditure allocation is paid by package equal to the average number of kilometers for working per month multiplied by the unit price and only applicable to regular business trips during the month.

Regarding the expenditure allocated for using cars, the Ministry of Finance proposes that: The agencies and units managing finance and assets, that are to act as the main agencies for the expenditure allocation of using cars determine the number of kilometers from the place of residence to the office, the number of actual working days in each month of each title; determine the average distance from the place of residence to the agency, the average number of days of transport of titles with standards of transportation from the place of residence to the agency and vice versa; determine the actual number of kilometers for each business trip of each assigned title; determine the monthly average number of kilometers a title travels for working.

Get ideas when buying car for project

The Draft circular of the Ministry of Finance also provides a provision about getting the consultation of state finance agencies when buying cars to serve a foreign non-refundable aid project.

Accordingly, for foreign non-refundable aid projects, the purchase of cars for the companies of each project shall comply with the provisions of the signed agreement, or the project documents approved by authorized agencies.

When negotiating to sign a document for a grant aid project that the donor requires to purchase cars for the operation of the project activities, in addition to complying with the order and signing procedures, joining and implementing International Treaty (international agreements); organizations and units are assigned to preside over for consulting the Ministry of Finance’s opinions (for projects implemented by central authorities) or Department of Finance (for projects implemented by local governments) before submitting to the competent authorities for approval the project acceptance.

The draft circular is being consulted widely before being signed by the Ministry of Finance and expected to replace Circular No. 159/2015 / TT-BTC of the Ministry of Finance, guiding some articles of Decision No. 32 / 2015 / QD-TTg of the Prime Minister prescribing standards, norms and regimes for management and use of cars in state agencies, public non-business units, one-member limited liability companies with 100% charter capital held by the State.
