Non-tradable goods without permit

The Customs branch at SaiGon port zone 1 has transferred the case of Hoang My Viet Import - Export, Trading and Express Services Joint Stock Company.

According to the Customs branch at SaiGon port zone 1, at the end of 2019, Hoang My Viet Import - Export, Trading and Express Services Joint Stock Company opened two declarations to import two shipments of non-tradable goods under bills of lading LAX-CATLAI-H1901A and CATLAI-H1901B.

When inspecting the goods, the Customs branch discovered most of the imported goods under the two above declarations were not eligible for import. The goods included more than 11,000 bottles of shampoo, facial cleanser and shower gel products. These products are subject to the list of imported cosmetics with written certification from the Drug Administration of Vietnam. In these two shipments, there were liquor and cigars which must be licensed for liquor distribution and an automatic import registration application issued by an agency of the Ministry of Industry and Trade. However, the company did not provide the documents.

In addition, when carefully inspecting goods, Customs also found some goods like decorative wooden clocks without trademarks and used a Studer 820 machine subject to the list of goods banned from import.

The Customs branch at Saigon port zone 1 has made a record of handling administrative violations for Hoang My Viet Import Export Trading and Express Services Joint Stock Company.

Investigating act of counterfeiting origin

The case of three imported containers of Chinese goods labeled as Vietnamese origin seized by the HCMCity Customs Department in early 2020 is also being investigated by the HCM City Public Security.

The shipment was imported by Super Foam Co., Ltd. (located at PhuChanh, Tan Uyen,Binh Duong). The imported goods were declared as mattress bags, made in China. Through profiling, the Customs branch at Saigon port zone 1- HCMCity Customs Department brought this shipment to the key supervision because of suspicions of fraud. Therefore, when Super Foam Co., Ltd. proposed to re-export the shipment, the customs branch did not accept and shifted to a physical inspection.

On January 3, 2020, HCM City Customs Department conducted a physical inspection ofthree imported containers and found 4,036 mattress bags labelled "Made in Vietnam", "Manufactured by Super Foam Vietnam". Ltd” (manufactured by Super Foam Co., Ltd, located in PhuChanh, Tan Uyen, Binh Duong, Vietnam).

Not only counterfeiting Vietnamese origin, on these imported goods, there were name of an importer as a company located in California, the US. This showedsophisticated fraud of origin and illegal transport. Customs officers who inspect goods of Super Foam Co., Ltd said the company intentionally imported fake goods of Vietnamese origin to illegally transportthem to the US market.

Super Foam Co., Ltd. was licensed for investment in Binh Duong in 1995 and started operation in 1996. This is a company invested by China and has had a long-time of operation in Binh Duong. After importing this shipment to Cat Lai port, although this firm received a notice from the shipping line, it has not yet carried out customs procedures to receive goods.
