Illicit aluminium "hidden" in rags - case prosecuted

However, through the process of gathering information, the Customs Branch of Da Nang port detected many suspicious signs and decided to stop transporting goods to conduct physical inspections.The shipment was registered by Thanh Hai Commercial Services Company Limited (at 158/3 Le Loi Street, Hai Cang Ward, Quy Nhon, Binh Dinh) on 2 export declarations at the Customs Branch of Da Nang port to Thailand and India. 2 declarations included 6 containers which were declared as rags packed into bags and automatically classified in the “Green Channel”.As the Customs Newspaper reported, on July 23, 2016, the Customs Branch of Da Nang port coordinated with the Anti-Smuggling and Control Team (Team 2) under the Anti-smuggling and Investigation Department to detect a case of illegally exporting aluminum ingots and bronze through Da Nang port.

The examination results of the Anti-Smuggling and Control Team (Team 2) and the Customs Branch of Da Nang port showed that the actual goods in the 6 containers included: Bronze scraps, with a weight of 41,130 kilograms and aluminum ingots with a weight of 98,600 kilograms. All of these goods were not listed on the Customs declarations.

According to the valuation documents of Vinacontrol on August 4, 2016, the total value of this shipment is about 5.566 billion vnd. This violation can be prosecuted with signs of smuggling under the provisions of Article 153 of the Criminal Code.

Through further verification, Customs forces discovered that from January 2016 to date, Thanh Hai Commercial Services Company Limited has implemented Customs procedures for 12 shipments of exported goods through Da Nang port, which have been declared as rags.

However, through physical inspections, the actual goods on 10 Bills of Lading were bronze scraps and aluminum ingots, with the total volume of 193.090 tons of bronze scraps and 171.730 tons of aluminum.Mr. Nguyen Trong Hai, the Director of Thanh Hai Commercial Services Company Limited admitted that he had falsified 12 purchase contracts with foreign partners to legitimize the export shipments which were inspected by Customs officers.
