This is a notice from the Ministry of Transport to the General Department of Customs to unify the quality inspection of forklift trucks.

Earlier, a number of Customs departments of provinces and cities have reflected difficulties arising in the process of quality inspections of forklifts. According to the Ministry of Transport's Circular No. 39/2016 / TT-BGTVT, forklifts with HS code 84.27on the list of potentially unsafe products and goods must be inspected. However, in practice, the Vietnam Register has refused to check the quality of some forklifts.

To deal with this problem, the General Department of Vietnam Customs has asked the Ministry of Transport to clarify the problems.

On this issue, the Ministry of Transport said that the Ministry of Transport was currently conducting quality inspections and environmental protection of specialized motorcycles in production, assembly and import. Forklifts are generally the items on the list of potentially unsafe products under the State management responsibility of the Ministry of Transport as stipulated in Circular 39/2016 / TT-BGTVT with the HS code of 84.27.

In fact, forklifts can have a need to be in traffic (for structured forklifts with access to traffic) to move among workplaces or participate in logistic activities in the field of transport (eg, loading and unloading goods on means at stations, ports and warehouses).

Explaining that the registry does not perform quality checks on forklift trucks, the Ministry of Transportation said in the past, due to the fact that the object has the same HS code duplicated in the legal regulations document of the Ministry of Transport and the Ministry of Industry and Commerce, there could be some types of forklifts that have two sets of specialized inspection. Due to the overlap, the registry of the Ministry of Transport purposely did not receive the above type of forklift to avoid overlapping.

However, the Ministry of Industry and Trade's Circular (most recently, Circular No. 33/2017 / TT-BTC amending and supplementing the HS codes in the List attached to Circular 29/2016 / TT-BCT) removed the forklifts from the list of goods subject to specialized inspections.

Therefore, in order to create favorable conditions for import-export business activities as well as quality control of commodity products, special-use vehicles with HS code 84.27 specified in Circular 39/2016 / TT-BGTVT, the Ministry of Transport continued to assign the Vietnam Register to inspect the imports of HS code 84.27, including duplicated goods that the Ministry of Industry and Trade removed from the list of goods subject to specialized inspections when imported.
