Luxurious assets for presentation: must be determined value based on market price before receiving and handing over

VCN – At the conference of seminar on the implementation of Law on managing and using public assets and documents regulating specific fulfillment, a representative of the Ministry of Finance said that, the assets for presentation must be approved by valuation council in order to determine assets’ value close to market price before being handled over or received for using.

Receiving the questions from reporters on the management and handling when receiving donated assets of state authorities, Mr. Nguyen Tan Thinh, Deputy Director General of the Public Property Management Department, Ministry of Finance, said: "Regarding the receiving of donated assets from individuals and enterprises, the Prime Minister has issued documents instructing ministries and localities to not accept these kinds of assets, especially high valuable assets such as cars.

However, in accordance with Decree 29/2014 / ND-CP dated 10/4/2014 of the Government regulating the competence and procedures for establishment of state property ownership for management and handling of assets which are established as State equity ownership, before presenting to the competent authorities and persons to allocate to a unit for usage, they must establish a valuation council for determining assets’ value close to market price.

Mr. Thinh took an example, the value of a car shown on the bill could be 1.1 billion VND, but when re-pricing the market price, it could increase up to 3 billion VND. From that, they will base on the price of 3 billion VND to determine the value of the car, it is not based on the value of the bill as previously.

The revaluation of assets at market prices will overcome the agencies receiving units to exceed the level of common standards.

Previously, according to Announcement 127 / TB-VPCP, the Prime Minister's conclusion on the receipt of automobiles granted by enterprises in February of 2017 clearly stated that the Government agreed and requested to stop receiving donations from enterprises, especially local enterprises operating business in the management area.

For presentations, receiving gifts from agencies, organizations and units using state budget, as well as officials, public servants, ministries, branches and localities, they shall strictly comply with the provisions of the Decision, No. 64/2007 / QD-TTg dated 10/5/2007 on presentation, receiving gifts and handing over gifts of the agencies, organizations and units using the state budget as well as officials.

For agencies and organizations that are proposing to donate, they must base on the current law provisions to determine the appropriation of receiving of transferred assets; The head of the agency shall be responsible for the receiving of assets in accordance with Decree 29.

To avoid negative phenomena, through the form of receiving gifts and presents from enterprises as well as to avoid loss of state property in the form of tax exemption for imported cars, the Prime Minister requests the ministries and provincial People's Committees shall terminate the receiving of the cars from the enterprises.
