In September 2016, N.S.K trading manufacture Co., Ltd (District 8, HCMC) did import procedures for a glass shipment through Cat Lai port. According to the Customs declaration, the shipment including 8,000m2 optical glasses use for making gas cookers, made in China with the total value over 574 million VND. The company presented C/O form E in order to get preferential tariff at 0%.

Through physical inspection, Saigon port area 1 Customs Branch detected, the actual goods were float glass in length and pure, without label, total value over 1 billion vnd. This item has import tax rate of 40%. Customs agency identified the total tax payment that need to lodge to State Budget of nearly 500 million VND.

Next, at the end of September 2016, N.M. Commercial Advisory and Advertising Co., Ltd (District 7, HCMC) opened a declaration at Saigon port Customs Branch. They declared that importing 4 goods items including over 102 tons of mirror glass, made in China, new 100%, import rate at 25%.

Through physical inspection, Customs agency detected 3 goods items with incorrect Customs declaration about name and quantity of goods. The actual goods were glasses, the import tax rate at 40%; the quantity of actual good exceeds the declared quantity over 170 m2. The total value was nearly 550 million VND, and a differential tariff of more than 127 million VND.

Working with Customs agency, a representative of the company said that, the actual imported goods do not match with the declared quantity because of foreign partner’s mistake. In that, for the wrong quantity of goods, the reason is that the foreign manufacturer didn’t produce in time under the first contract. Hence the foreign partner actively transported goods to the company under the next contract. For the exceeded quantity when importing, it was because the partner sent extra items in order to deduct the loss due to breakage.

According to the findings of the Customs Newspaper correspondent, most cases of imported construction glass that were detected recently, were imported from China. Currently, Customs Branches at border gates have set these items as the focus for inspection, enforcement and prevention of violation, especially in the peak at the end of the year.

In order to prevent this phenomenon, recently, Customs Control and Supervision Department (General Department of Customs) requested local Customs Branches and cities to strengthen inspection and control of imported glass for construction declared as white glass, with processed edge, made in China with HS code: 7006.99.90, especially for combined transport declaration, and independent transport declaration. The management of product quality and imported construction glass must comply with the provisions of Circular 11/2009 / TT-BXD of the Ministry of Construction.
