The MoF said, on June 13, 2019, the XIV National Assembly approved the Law on Tax Administration 38/2019/QH14, effective from July 1, 2020. To implement this law, the Government issued Decree 123/2020 stipulating invoices and documents.

The most important new point of Decree 123 is the regulation on the management and use of e-invoices, whereby, from July 1, 2022, all enterprises and organizations, business households and individuals must issue e-invoices (except for those that are ineligible), those that meet the conditions for information technology infrastructure, are encouraged to apply electronic invoices before July 1, 2022.

The ministry said that e-invoice implementation is one of the important contents to promote digital transformation for businesses and financial agencies as well as other state agencies; and this brings many common benefits to society, such as saving costs, resources, human resource and protecting the environment.

In order to implement e-invoices, the MoF issued a Decision on implementing e-invoices for the second phase in 57 provinces and cities from April 2022.

From now to April 2022, the ministry proposed the leaders of localities pay attention and coordinate in directing a number of key tasks in their areas.

Accordingly, tax departments are required to report to the provincial and municipal People's Committees on establishing a steering committee for e-invoice application in their areas, mentioned in this decision.

The Steering Committee will be led by the director of the tax department and attended by representatives of leaders, civil servants of branches and divisions of the tax department and representatives of relevant agencies.

The Ministry of Finance also required that the leaders of provinces and cities direct the Departments of Information and Communications and local media agencies to strengthen information about the significance and benefits of e-invoices and new contents of Decree 123/2020 and Circular 78/2021 of the Ministry of Finance.

At the same time, the leaders of provinces and cities direct the Department of Planning and Investment to notify new businesses of their rights and obligations in using e-invoices.

The leaders of provinces and cities also request state management agencies in their areas in need of using e-invoice information such as market surveillance, customs, police, to prepare the necessary technical conditions to be ready for connection and searching of e-invoice information.

In particular, the MoF proposed the leaders of provinces and cities guide the police agency to promptly catch new forms of fraud for illicit profits or tax appropriation to develop solutions.
