Promote public property management in accordance with the Law

VCN  - After more than a year of the law on management and use of public property in Life, ministries and agencies have implemented it but still "somewhere" has been implemented slowly. In the future, the Ministry of Finance will submit to the Prime Minister a directive to tackle this issue.

No standards for using assets in health and education

The recent summary of the Ministry of Finance shows that the progress of issuing standards and norms for using specialised office space is still slow; documents decentralised authority have not yet issued timely, leading to wrong authority when deciding to procure and handle public assets. It is the slow progress of promulgating standards and norms for use of specialised office areas, non-business facilities, specialised machinery and equipment, affecting investment, procurement, repairing and handling property Management. Up to now, about 50 percent of ministries, branches and localities have issued standards and norms for specialised machinery and equipment. The rest of the ministries, branches and localities have not yet promulgated standards and norms for specialised areas and non-business facilities in non-business establishments.

The main reasons are due to a number of ministries such as the Ministry of Health, Education and Training, Labour, War Invalids and Social Affairs which have not promulgated detailed guidelines on standards and norms for use of specialised properties. In the fields of health, education and training, ministries, branches and localities have no basis to formulate and promulgate standards and norms for agencies, organisations and units under their management. In addition, due to the number of specialised machines and equipment, the area of specialised offices, the area of many non-business works, diverse types, each agency and unit have different needs, so the collection, standards and norms have not been developed timely.

According to Nguyen Tan Thinh - Deputy Director of the Department of Public Administration, Ministry of Finance, a number of ministries, branches and localities have not yet issued timely decentralised documents to enforce the law. There are a number of ministries, branches and localities that continue to use the decentralised regulations issued before the effective date of the law, which can lead to wrong authority when deciding to procure and use public properties.

Provisions on large value assets to determine authority

To overcome this, the Ministry of Finance is submitting to the Prime Minister a draft directive on the implementation of the Law on Management and Use of Public Assets and documents detailing the implementation of the law, of which ministers, heads of central agencies, provincial-level People's Councils, provincial-level People's Committees, and provincial-level People's Committee presidents will be required to urgently issue regulations on decentralised management of public assets according to regulations; decentralization of authority to promulgate standards and norms for use of special-use public properties (area of non-business works belonging to non-business establishments, specialised cars, machinery and specialized equipment under its management physical).

When regulations have not been promulgated yet, the promulgation of non-business facilities under non-business establishments, specialised cars, standards and norms of specialized machinery and equipment will fall under the jurisdiction of Ministers, Heads of Central agencies, Provincial People's Committees. The approval of the plan for handling property is established with the ownership of the entire people under the authority of ministers, heads of central agencies and provincial-level People's Committees (except in some cases).

For delays as mentioned above, it is necessary to promulgate detailed guidance on standards and norms for use of public properties for special use in the fields of health, education and training. On that basis, ministries, central agencies and provincial-level People's Committees shall direct the elaboration and promulgation of standards and norms for special-use public assets according to their competence to serve as a basis for assignment and investment, procurement, management, use and handling of public assets for units under their management.

The Ministry of Finance also proposed the Prime Minister to direct ministers, heads of central agencies and provincial-level People's Committees to urgently issue regulations on assets of great value to determine the competence to approve projects on asset use at public non-business units, organisations under their management for business and lease purposes. In cases where this regulation has not been issued or is not promulgated, the approval of the project is within the competence of the ministers, heads of central agencies and provincial-level People's Committees.

After a year of implementing the Law, the Ministry of Finance has organized an online conference to listen, solve difficulties and urge ministries, branches and localities to promptly review and promulgate regulations according to their competence. However, to date, this has not progressed. Therefore, the lead agency places expectations on the promulgation of the Prime Minister's Directive to make positive changes so that public assets continue to be strictly managed, economically and effectively used, avoiding State property losses.
