Repeatedly faking name of enterprise to smuggle

The declaration was registered twice, but procedures are not done

A 40 feet container of imported goods landed at Cat Lai in 2017. At the end of May, the Sun Flower Transport Company Limited (275/13/38 Ha Huy Giap, District 12, Ho Chi Minh City) opened the Import customs declaration documents, declaring the goods as used marine engines and steel cables. However, after opening customs declaration, the enterprise did not come to do customs procedures. On 2/7/2018, this company continues to open customs declarations, but after many months, this company still does not do customs clearance.

After detecting customs declarations twice and the enterprise still not conducting customs goods clearance, the Customs Control Team (Customs Department of Ho Chi Minh City) targeted the enterprise for key tracking. On November 8th, the Customs Control Team in coordination with the Inspection Team and the Customs Sub-Department of the port of Saigon port No. 1, conducted the key inspection of this import lot. Opening for actual inspection, the customs agency discovered the container was full of spare parts, old automobiles, camouflaged at the front of the container with two steel cable coils. Noteworthy, the parts, components, motor cars were very old, they were severely rusted. Except for the two winding cables that were properly declared, all the rest of the spare parts, components and automobile machinery contained in the container are prohibited imports.

According to the leaders of the Customs Control Team, through the observation of evidence at the scene showed that the object’s tricks are very sophisticated, the components and machinery were likely to be used passenger cars that were cut-up for transport to Vietnam.

Through the verification of the Customs, Sun Flower Logistics Co, Ltd., is no longer operating at the above registered business address. Also, the business did not contact the customs authorities to handle the shipment, although Customs has sent many letters of invitation for work procedures. At present, the customs office is requesting to inspect all the above mentioned goods, and a further investigation will be made.

Implementation of many specialized projects

Recently, many batches of illegally imported goods detected by the Customs Department of Ho Chi Minh City were identified with non-operation of businesses at the registered business address; it showed that the state of fake businesses conducting illegal smuggling and import of prohibited goods is recurring.

Recently, the Customs Sub-Department of the port of Saigon Port, Region I, has detected and prevented 25 containers of discarded materials imported into Cat Lai port. However, the enterprise declared that the imported goods are used machinery and equipment. Expanding the investigation, the customs agency determined, Tri Quang Transport Company Limited (60 Nguyen Van Giap, Binh Trung Dong Ward, District 2 HCMC) was established without operating at the registered business address.

According to leaders of HCMC Customs Department, together with the anti-smuggling and trade fraud schemes in the last months of the year, the unit is carrying out many specialized actions to prevent the effectiveness of illegal goods and smuggled goods being brought inland. Especially for goods that have been docked, but enterprises have not cleared customs.

Mr. Phan Manh Lan, Head of the Customs Control Team of the HCM City Customs Department, said that the team is coordinating with the units to implement the project "Fighting against smuggling of trade frauds of unsold goods at ports of Ho Chi Minh City having signs of law violations", directed by the Customs Department of Ho Chi Minh City. The detection of the above-mentioned goods lots is the first specialized result. This project is to be continuously implemented by the Customs Department of Ho Chi Minh City until mid-2019 with a view to detecting and preventing prohibited lots and smuggled goods in containers at the port of Ho Chi Minh City.

Along with this action, the customs department of the port of Saigon port I is also implementing specialized projects to prevent poor quality discarded scrap. Initially, the Sub-Department has controlled, effectively prevented the abuse in the declaration of the name of the goods to bring scrap that does not meet port standards.
