Replace the civilian code product nomenclature for exporting & importing with licenses

VCN – The Government has issued a Decree 53/2018/NĐ-CP on amending and supplementing the Decree No. 58/2016 / ND-CP of the Government dated 1/7/2016 detailing the trading of products and services of civilian code and export and import civilian code products.

Specifically, replace the Appendix II of the civilian code product nomenclature for exporting & importing with licenses at the Decree 58/2016/NĐ-CP dated 1/7/2016 of the Government by Appendix II of the civilian code product nomenclature for exporting & importing with licenses attached with this Decree.

This nomenclature includes: Printers use printing components such as printing plates, printing tubes and other printing components; other printers, copying machines and fax machines, whether or not combined; parts and accessories thereof; automatic data processing machines and their function blocks; magnetic readers or optical readers; data transmitters on data transmissions in coded form and processors of these data, not elsewhere specified or included; parts and accessories (except case and other similar) used solely or principally with the machines of headings 84.70 to 84.72;

On the application of the civilian code product nomenclature for exporting and importing with licenses, the Decree states that the civilian code product nomenclature for exporting and importing with licenses shall apply only to civilian code products which are matched to the HS code, the name and description of the cryptographic function in the nomenclature.

In cases where there are differences in the identification of goods codes on the list issued together with this Decree and the List of Import and Export Goods of Vietnam, the Ministry of Finance (the General Department of Vietnam Customs) chaired and coordinated with Ministry of Defense (Board of Government Confidential) to decide on HS codes for export and import goods.

Licenses for export or import of civilian code products already granted to enterprises shall continue to be valid for the duration stated in the permits for civil code products which are named according to the import-export goods nomenclature

Customs authorities shall base on import – export license of civilian code products which is granted and the actual import – export goods for determining HS codes and implementing clearance procedures for enterprises.
