Rolls-Royce importers make tax payment of more than 1 billion VND

According to Mrs Nguyen Thu Nhieu, on 13th December 2016, REGAL MOTOR CARS.,CORP (a retailer of Rolls-Royce company in Vietnam) paid 1.2 billion VND to the State Budget, of a total of nearly 50 billion VND. It was collected by the Customs agency on tax arrears for this enterprise. It was known that the amount of tax arrears related to acts of declared lower additions and wrong HS codes of imported goods.
However, a large amount of tax was related to tax arrears for full set cars that the enterprise hasn’t implemented Customs authority’s decision yet and was still making a complaint.
Earlier, as the Customs newspaper reported, following the instruction of the Ministry of Finance and the General Department of Customs about strengthening the fight of against smuggling and trade fraud on importing cars, Hai Phong Customs Department conducted post-clearance audit in accordance with the law at the office for REGAL MOTOR CARS.,CORP (retailer of Rolls-Royce company in Vietnam) .
The post-clearance audit was performed through checking documents related to import consignments such as Contract agents, Order confirmation, Invoice, packing list, ... As a result, the Customs authority detected and identified a number of violations of REGAL MOTOR CARS, CORP. in undeclared discounts at the time of doing registration of Customs declarations for 19 Roll-Royce cars, declared lower additions, and declared wrong HS code for automobile spare parts in 40 Customs declarations.
According to Post-Clearance Audit Customs Branch (Hai Phong Customs Department) - unit directly handling the case, the behavior of the enterprise has violated the provisions of Article 6, Article 13 and Article 15 of Circular 39/2015/TT-BTC stipulated on Customs valuation, Article 143 Circular 38/2015/TT-BTC regulated on Customs procedures; inspection and supervision; export tax, import tax and tax administration for exported - imported goods.
From the above facts, the Customs agency rejected the transaction value of REGAL MOTOR CARS, CORP. and collected the amount of tax arrears nearly 50 billion VND.
