On 13 March 2019, Nghi Son Seaport Customs Branch (under Thanh Hoa Customs Department) said that the case was transferred to the Police of Thanh Hoa province for further investigation and handling.

Previously, at the beginning of 2019, through grasping the situation, the competent agencies of Thanh Hoa province discovered a shipment of fake Long Son cement for export. After receiving information, the Steering Committee 389 of Thanh Hoa province assigned Thanh Hoa Customs Department to chair and coordinate with the competent agencies to handle the case.

On 30 January 2019, Nghi Son Seaport Customs Branch detected Viet Nam Import- Export and Trading Service Co., Ltd., (address in Hanoi) loading goods into Tan Binh Vessel 236, at Dai Duong Port of Nghi Son Economic Zone (Tinh Gia district, Thanh Hoa province).

The competent agencies inspected and detected that about 12,000 tons of cement were loaded into the vessel and another 6,000 tons in the warehouse were prepared for loading into the vessel. The total amount of cement was stated in a contract for supplying 21,000 tons of Long Son Cement which was signed with a foreign company, and declared in the export declaration by the Viet Nam Import-Export and Trading Service Co., Ltd.

Conducting an investigation, Thanh Hoa Customs Department determined that the above cement was made by Hoang Mai Cement Plant and packed with the Long Son brand in sacks. Viet Nam Import-Export and Trading Service Co., Ltd., is a company specializing in transactions with foreign partners, then ordering cement manufacturing plants for export.

The leader of Nghi Son Seaport Customs Branch said that talking with the competent authorities, Long Son Co., Ltd., also confirmed that the above cement shipment was not the company’s product.

Because the case is beyond Thanh Hoa Customs Department’s competency, the Department has transferred the case to the the Economic Police Department of Thanh Hoa Police to investigate and clarify. However, after basing on the provisions of the law, Thanh Hoa Police transferred the case to Nghe An Police to continue investigating and handling.

The case is being investigated and clarified for whether or not Viet Nam Import- Export and Trading Service Co., Ltd., and Hoang Mai Cement Plant (Vicem Hoang Mai Cement Joint Stock Company, located in Hoang Mai town, Nghe An province) infringed intellectual property rights in making fake Long Son Cement Brand (Long Son Co., Ltd., address in Bim Son town, Thanh Hoa province) to export 21,000 tons of cement.
