The draft Decree amending Article 25, supplement 4 new Articles, abrogate 2 Articles (Clause 3 of Article 14 and Point b, Clause 4, Article 20 of Decree No. 134/2016 / ND-CP).
The basic content of the draft decree amending Decree 134 focused on the following groups of contents: Group of provisions on applying import-export tax rates; guarantee for tax payment, preferential for tax exemption, tax exemption determination, subjects and conditions of preferential investment (amended 9 articles); Group content of dossiers, procedures for tax exemption, tax refund (16 amendments and supplements, supplementing 4 new articles).
Previously, on 22/5/2018, the Government Office issued Official Letter No. 4765 / VPCP-KSTT on removing difficulties and obstacles of enterprises in the tax and customs field. In that, the informing comments by the Prime Minister assigned the Ministry of Finance to promptly research and propose amendments or modifications in accordance with their competence and be completed in the third quarter of 2018 for the contents specified in Article 12 Decree No. 134/2016 / ND-CP, in the direction of import tax exemption for raw materials and auxiliary materials for processing at other production establishments, and for goods imported for the production of export goods that are destroyed on the basis of equality between the type of export production and the type of processing.
The Ministry of Finance has reviewed and evaluated the implementation of Decree 134/2016 / ND-CP and summed up the recommendations and problems arising from the implementation of Decree No. 134/2016 / ND-CP in order to develop a draft Decree on amending and supplementing Decree No. 134/2016 / ND-CP.
