According to Nguyen Thanh Long, Deputy Manager of Sai Gon Seaport Customs Branch of Zone 1, 31 shipping lines must re-export 1,099 containers of imported scrap that are not eligible for import.

However, after a long time of the goods arriving at the port, the goods owners have not received goods, so shipping lines must re-export these goods to avoid hurting the environment.

According to Sai Gon Sea port Customs Branch of Zone 1, as of the end of April, about 2,000 containers of scrap are backlogged at Cat lai Port. Of which, 363 containers have been locked by Customs because these containers are under special cases that are being investigated and adjudicated and 138 containers had their customs declaration opened but enterprises did not receive the goods.

The Sai Gon Sea port Customs Branch of Zone 1 has worked with units in the board for handling backlogged goods to classify and handling the remaining1,500 containers.

Through inspection and classification, Customs discovered more than 70% of imported scrap containers did not meet quality standards. Specifically, among more than 1,500 classified containers, Ho Chi Minh City Customs checked and determined 1,099 scrap containers.

The scrap was mainly plastic film, uncut package, old tires, dirty and stinky garbage. The scrap was imported by enterprises to Cat Lai Port in 2018 and they did not receive. So it takes a lot of time for Customs and port operators to handle to avoid affecting the environment.

The board for handling scrap backlogged at Cat Lai Port (including Customs, Saigon New Port Corporation and some departments and branches of Ho Chi Minh City) agreed the handling solution of forcing shipping lines to re-export 1,099 scrap containers not eligible for import.

Taking responsibility for transporting goods, shipping lines' representatives said the failing to receive goods by goods owners caused damage to the shipping lines, including failure to circulate containers due to the long backlog at the port. Shipping lines also believe the re-export of scrap to other countries will be very difficult

According to current provisions, there is sufficient basis to claim liability for shipping lines. In Clause 6, Article 58 of the 2014 Customs Law: For polluting goods, owners and drivers of vehicle or persons authorised by owners of vehicle shall transport such goods out of Vietnamese territory.

Article 74 of the 2005 Maritime Law stipulates the time of arising and termination of liability of carrier. Accordingly, the liability of a carrier shall arise from the time the carrier receives the cargo at the port of receipt, continue throughout the process of carriage and terminate upon the completion of delivery of the cargo at the port of delivery.
