Domestic Market Department (Ministry of Industry and Trade) stated that under the Prime Minister's instruction in Official Dispatch No. 12070 / VPCP dated 11th November 2017, the Ministry of Industry and Trade was appointed to review and evaluate the implementation of Decree No. 02/2003 / ND-CP dated 14th January 2003, and the Government's Decree No. 114/2009 / ND-CP dated 23rd December 2009 on market development and management, and proposals for amendments and supplements in accordance with the Law on the Promulgation of Legal Documents.

With the development of supermarkets, trade centers and proposals of localities for the type of commercial infrastructure (markets, supermarkets, trade centers ...) The Ministry of Industry and Trade is proposing to draft a Decree on the development and management of commercial infrastructures.

The Government's Decree on the Development and Management of Commercial Infrastructures addresses many objectives.

Firstly, creating a legal corridor, creating a transparent and favorable environment, promoting synchronous development of various types of commercial infrastructures, including markets, supermarkets, trade centers, shopping malls, convenience stores and related business activities.

"The draft decree will not create more business conditions and not generate sub-licenses, hindering business activities of enterprises, but is for creating legal corridors to remove barriers and solve difficulties for enterprises, improve the business investment environment and better meet the needs of consumers," The representative of the Domestic Market Department emphasized.”

Secondly, overcoming obstacles and inadequacies arising from the actual implementation of the current types of commercial infrastructures while ensuring the inheritance of the appropriate regulations of the relevant documents in order to create a comprehensive legal corridor for the development and management of commercial infrastructures.

Thirdly, accelerating the development of various types of commercial infrastructures towards civilization and modernization, preserving and promoting traditional cultural values, ensuring circulation of goods in these types having clear details of origin, ensuring food safety and protecting the interests of consumers ...

Fourthly, supporting for market access and facilitating the consumption for Vietnamese goods and goods of domestic small and medium enterprises in the above types of commercial infrastructures.

To prepare the draft Decree on the development and management of commercial infrastructures, the Ministry of Industry and Trade has been implementing steps in accordance with the Law on the promulgation of legal documents in 2015. The Ministry of Industry and Trade has affirmed that it will continue studying, adopting and finalizing the proposal to draft the Decree in accordance with the order and provisions of the Law on the Promulgation of Legal Documents.

Previously, the draft decree on the development and management of commercial infrastructure was named by the Ministry of Industry and Trade as Draft Decree of the Government on development and management of the distribution sector.

During the consultations with the concerned enterprises and units, the contents in the draft received many different opinions and even concern about the possibility of causing more difficulties, creating more "sub-licenses" for enterprises.
