An enterprise refused to receive nearly 450 scraps containers

VCN – An enterprise located in Hung Yen imported nearly 450 containers of plastic scraps to Cat Lai port. Then they refused to receive those scraps with the reason of, “sent by mistake”.

This is a case of H.Q.C.H Co, Ltd., (Cam Giang District, Hung Yen Province). According to Saigon port area 1 Customs Branch, from February to May in 2018, this company has undersigned on the bill of lading for importing 437 containers of plastic scraps to Cat Lai port.

However, when the customs authority sent a document to request the company to come for working on the above scraps, the enterprise sent an official letter to the customs authority and the shipping company refusing to receive 437 containers of plastic scraps as mentioned above, with the reason, “sent by mistake”.

The representative of this company said that they did not sign a contract to buy the above shipment from the exporter, so that those containers are not owned by the company. This company requested the shipping agent to send a notification to the consignor and the relevant agency about the refusal to receive the goods of this company.

Similarly, V.N. Company (Duc Hoa district, Long An province) also refused to receive 255 containers of imported plastic scraps which are located in Cat Lai, although the information on the bill of lading showed the recipient is V.N. Company. Although the company did not give any reason for their refusal, the company said that through the specific inspection of documents, the enterprise found that those shipments were not owned by themselves.

Moreover, the state of refusals to receive scrap occurs normally when the customs authority bases on the name of the consignee shown on the bill of lading, in order to send a letter of invitation for working a case related to hundreds of backlogged container scraps in Cat Lai port.

In addition, the Industrial Environment M.P Company (Bac Ninh province) also refused to receive 68 containers of plastic scraps; One enterprise in Ben Cau district - Tay Ninh has refused to receive 29 containers of plastic scraps which have been docked for many months.

Those enterprises refused to receive goods giving several reasons. However, through a discussion with the Customs News’s reporter, a customs official said that in fact, many enterprises importing scrap to seaport were not granted a "Certificate of eligibility for environmental protection in import of scrap for use as raw production materials”, so they refused to receive the shipments.

At present, the above scraps are being classified and handled by the Saigon port area 1 Customs Branch in coordination with relevant units. If the scrap does not meet import quality standards, it will be forced to re-export.
