Aviation NSW: many obstacles to be removed

At the third Meeting of the National Steering Committee for the National Single Window, ASEAN Single Window and Trade Facilitation (1899 Steering Committee), the Director General of Customs Nguyen Van Can showed the problems in the implementation of the aviation NSW under Decision No. 43/2017 / QD-TTg.

According to the Decision, the aviation NSW officially came into effect on 15th November2017. Meanwhile, under the provisions of Decree 27/2011 / ND-CP, the airport authority will receive advance passenger information and share it with Customs authority, border police and immigration agency under the Ministry of Public Security. However, the aviation NSW fails to access information related to cargo or passenger name records. This information is only received through the NSW. Thus, the enterprise must send information to the two systems. The passenger name record is a new content so airlines proposed to prolong the deadline for information submission to the first quarter of 2018.

Mr. Nguyen Van Can said that, the aim of the Government in the application of NSW is to developtheunique point thatitreceives information and documents electronically for state agencies to carry out administrative procedures for passengers, means on exit, entry or in transit; and goods exported, imported or transited. Therefore, the maintenance of the two systems to receive air information is not effective and fails to facilitate the enterprises.

Therefore, in order to ensure the implementation of the aviation NSW, the Ministry of Finance (General Department of Customs) proposed that the Ministry of Finance must ensure the availability of the NSW to officially launch the aviation NSW, and chair and collaborate with the Ministry of Transport, the Ministry of Public Security, the Ministry of Agriculture and Rural Development and the Ministry of Health to officially launch aviation NSW under Decision No. 43 / 2017 / QD-TTg. The Ministry of Finance shall cooperate with the Ministry of Transport and the Ministry of Public Security to report to the 1899 Committee on the time of connection of the system with NSW.

At the same time, Ministry of Transport, Ministry of Public Security, Ministryof Agriculture and Rural Development and the Ministry of Health should urgently coordinate with the Ministry of Finance to officially launch the aviation NSW according to Decision 43/2017 / QD-TTg.

While waiting for connecting to aviation NSW, with NSW, the Ministries undertake the reception and exploitation of information related to aircraft, passengers, air fleets and cargo at the NSW. The Ministry of Transport and the Ministry of Public Security will complete their system to connect with NSW in order to receive information related to aircraft on exit, entry and in transit no later than March 2018. Regarding the reception of passenger name record, the Ministry of Finance shall continue the reception of above information for airlines that have good technical preparation and also coordinates with Air France-KLM on sending the passenger name record.

Deputy Minister of Transport Nguyen Van Cong affirmed that the units under the Ministry had worked with the General Department of Customs and agreed that the Ministry would transfer the process and reception of aviation information to the NSW and update its 3 administrative procedures to the system. However, the current difficulty for the Ministry of Transport is it isstill responsible for the implementation of Decree 27/2011 / ND-CP. Therefore, it is necessary to amend Decree 27/2011 / ND-CP of the Government to remove the difficulty.The Ministry of Transport is ready to transfer aviation administrative procedures to the NSW.

Facing with the difficulties in the aviation NSW implementation, Deputy Prime Minister requested the Ministry of Finance that the Ministry should ensure the NSW availability to officially launch it. In addition, the Ministry of Transport should be responsible for chairing and collaborating to review and amend Decree 27/2011/ND-CP in order to remove the problem that airlines must submit information to the 2 systems as at the present time.
