Car imports by Toyota confuses the Customs

According to Dinh Vu Port Customs Branch (Hai Phong Customs Department), recently, Toyota Motor Vietnam Co., Ltd opened a declaration at the Branch to import 3 CBU cars from Indonesia. During the implementation of Customs procedures, the Company submitted an import license issued by the Ministry of Finance in line with provisions of Decree 116/2016/ND-CP.
However, in order to complete the Customs procedures and clearance for these CBU cars, the Company must register for them and submit the register results to the Customs.
But Toyota Motor Vietnam Co., Ltd said that the company imported these cars for research purposes, not for business, so these cars were not subject to registration.
“If the company imports cars for research, it will not have to apply for the import license from the Ministry of Industry and Trade as per provisions of Decree 116. However, the company applied for the import license but does not want to register for these cars, causing confusion for the Customs in carrying out Customs procedures”- the leader of Dinh Vu Port Customs Branch said.
According to the leader of the Branch, in order to facilitate the company, the Branch advised that if the company imported cars for research purposes, it could open a temporary import declaration and then re-export these cars. Therefore, the company would not have to register. However, the company did not agree with the advice from the Customs and still wanted to import the cars under A11 regime (import for business).
