Clarify functions and duties of Customs Branches
The decision was issued by the General Department of Customs to implement Decision 1919/QD-BTC of the Ministry of Finance dated 6-9-2016 regulating functions, duties, powers and organizational structure of the Customs Department in provinces or cities under central authority.
Specifically, Decision 4291/QD-GDC dated 12-12-2016 stipulates the functions, tasks, powers and organizational structure of the staff unit to advise and assist the Director of the Customs Departments in provinces and cities. In particular, along with the decision is the task assignment of the staff units.
Hence, Decision 4294/QD-GDC dated 12-12-2016 i clearly defines the functions, tasks, powers and organizational structure of the Customs Branches provincial, inter provinces and cities with 22 tasks and authority. Besides a number of key functions and tasks such as carry out Customs procedures, Customs inspection and supervision, there are some functions and powers are supplemented such as: conducting post clearance audit for export and import goods, implementing the priority mode for enterprises and applying advanced science, technology and methods of modern customs management in the activities of the Customs Branch, etc.
Furthermore, Decision 4293/QD-GDC dated 12-12-2016 that regulated the functions, tasks, powers and organizational structure of Post Clearance Audit Customs Branch under Customs Department in the province and city, clearly stated 17 missions, and authority of the force. Those units have functions to help the Director of Customs Department in managing, directing, guidance and inspecting te post clearance audit; directly doing post clearance audit and manage AEO in accordance with the law for import-export goods.
Moreover, Decision 4294 / QD-GDC dated 12-12-2016 that regulates the functions, tasks, powers and organizational structure of the Customs Enforcement Team under Customs Department in provinces and cities, also clearly prescribed 9 missions and powers of the force. Those are the functional units directly Customs controls to combat smuggling, trade fraud, and illegal transportation of goods across borders within the Customs operation area which are managed by the Customs Department.
Additionally, in Decision 4295/QD-GDC dated 12-12-2016 that stipulated the functions, tasks, powers and organizational structure of the Anti-drug Enforcement team under Customs Department in the province and city, General Department of Customs has clearly defined 10 tasks and powers of the force. This force has a directly organized the fight to against trafficking, illegal transportation of drugs and precursors across borders within the customs operation area that managed by the Customs Department.
All these Decisions shall be valid from the date of signing (December 12th 2016), and replaced the previous decision of the General Department of Customs on the functions, tasks, powers and organizational structure of the units.
Reportedly, in parallel with the issuance of the decision, the General Department of Customs has a written document to request Customs Departments of the provinces and cities, in that publicizing the contents of the decision to Customs officers. At the same time, implementing the functions, powers and organizational structure of the units as prescribed and assigned by the General Director in the decision above. Allocating Customs officers of units by following the organization model in Decision 1919/QD-BTC as decentralized management of the Ministry of Finance and the General Department of Customs.
