VCN - Regarding the question of the Vietnam Dairy Products Joint Stock Company (Vinamilk) on the conditions for application of special preferential import tax rates ATIGA to on-spot imports and exports, the General Department of Customs has recently given a written answer to this company.

Questions from Vinamik are being reported to the competent levels by the General Department of Customs

Accordingly, under the provisions of the Decree No. 129/2016 / ND-CP of the Government, commodities subject to special preferential tax rates must satisfy the conditions prescribed in Clause 1, Clause 2, Clause 3, andClause 4 of Article 4 of this Decree. In particular, Clause 2 of Article 4 stipulates that Vietnamese goods must import from non-tariff areas into the domestic market.

Vinamilk's application for special preferential tax rates for Vietnamese goods imported on the spot, fail to meet the provisions of Article 4 of Decree 129/2016 / ND-CP.The General Department of Customs said that the unit was currently collecting information and evaluatingtheimpact before reporting to competent authorities of howto handle in accordancewith regulations.

Earlier, in early December 2017, Vinamilk wrote a proposal on tax collection plans by local Customs for sugar shipments imported from 2016, for the company to be entitled to special preferential tax rates for goods imported in the form of on-spot import and export.

In this regard, the General Department of Customs issued a written reply to a number of press agencies, that in order to strengthen the inspection of origin to ensure uniformity and compliance with the current regulations, the General Department of Customs has sent the Official Letter No. 2668a / GSQL-GQ4 to guide the local Customs department to strictly comply with the provisions of the Government's Decree No. 129/2016 / ND-CP dated 1st September 2016.In this respect, only on-sport imports from non-tariff areas with avalid C / O issued by the Ministry of Industry and Trade can be considered to be entitled to special preferential tax rates.
