According to provisions of Point a, Clause 9, Article 13 of Circular 12/2015/TT-BTC of Ministry of Finance, a Customs Broker has responsibility for making the periodic operation report on the 5th of the first month of the next quarter under the form to send to provincial and municipal Customs Department or providing the other necessary information serving the Customs management upon written request by the Customs.

However, a recent review by Ha Noi Customs Department has shown that 93 of 190 Customs brokers managed by the Department have not reported their periodic operation. Notably, the Customs cannot contact 32 Customs brokers at their registered address.

Ha Noi Customs Department said that this problem still takes place even though the Department has sent the official letter to each Customs broker to request they fully comply with provisions of the law on the rights and responsibility of Customs broker, including signing agent contracts with goods owners; Using account and digital signature of Customs broker; Managing and using code of Customs broker staff to declare and carry out Customs procedures upon authorization by the goods owner; Reporting the change in Customs broker or staff, etc; Making the periodic operation report of Customs Broker in accordance with Point a Clause 9 Article 13 Circular 12/2015/TT-BTC of Ministry of Finance.

At the end of 2017, the General Department of Vietnam Customs (GDVC) issued an Official letter to guide the implementation of Customs procedures of Customs brokers. In which, the GDVC set out requirements for Customs brokers who have not fully fulfilled their responsibility as Customs brokers in accordance with Article 13 Circular 12/2015/TT-BTC, to urgently overcome their violations and implement the report regime, and announce changes in information (name, business address) of Customs brokers, and in Customs broker staff (returning codes of Customs broker staff in line with provisions in Point d, Clause 1, Article 10 of Circular 12/2015/TT-BTC and proposing the granting codes for new staff meeting requirements as per provisions); and the deadline for overcoming these, is the end of 15th December 2017. If out of the deadline, illegitimate Customs brokers fail to overcome or continue violations, provincial and municipal Customs Departments will report to the GDVC to suspend or stop their operation under the law.
