Delay in notifying quality inspection result

Accordingly, the General Department of Customs requested ministries to review and re-evaluate the capacity of the specialized inspection agency to avoid prolonging the inspection time, affecting the clearance time and cross-border trade transaction index

According to the provisions of Article 35 of the Customs Law, for cases where goods are subject to specialized inspection for quality, health, culture, animal and plant quarantine and food safety inspection for imported goods and means of transport, the customs agency shall base the inspection results of the specialized inspection agency to decide on customs clearance..

The time limit for specialized inspection of goods is in accordance with relevant laws. The specialized inspection agency shall have to notify the customs agency of the inspection results within two working days from the issuing date of the inspection results.

Under Clause 16, Article 1 of the Government's Decree No. 59/2016 / ND-CP dated April 20, 2018 (amending and supplementing Decree 08/2015 / ND-CP dated January 25, 2015): Within ten days from the issuing date of the application for inspection registration is issued or the date of sampling for specialized inspection, unless otherwise prescribed by the law on specialized inspection, the specialized management agency or the competent specialized inspection agency must conclude the inspection and send the inspection results to the customs agency according to Article 35 of the Law on Customs or send it to the national single-window portal if the inspection agency connects with the national single-window portal for the customs agency to decide the clearance.

If the prescribed time limit is over, or if the specialized management agency or specialized inspection agency has not yet made a specialized inspection conclusion, a written explanation and the issuing date of the inspection conclusion must be sent to Customs.

However, though the time limit for specialize inspection is over, many shipments put into storage for specialized inspection have not yet received the inspection result notification. Some inspection agencies have responded in writing to the delay in notifying the inspection results but have not stated the issuing date of the inspection results, so many imported shipments have not been cleared.

This makes it difficult for the customs agency in management and supervision andfor enterprises in goods trading.

The General Department of Customs said that in order to have a basis for customs clearance for imported shipments, ministries must guide the specialized inspection agency to promptly issue the inspection result and send it to the Customs agency through the national single-window portal. If the inspection result cannot be issued, it is necessary to clearly state the reasons and solutions and clearly define the issuing date of the inspection results.
