Final review of the draft Circular amending and supplementing Circular 38/2015 / TT-BTC

The participants in the review were representatives of the operational units under the General Department of Vietnam Customs and representatives of a number of large Customs units such as Hanoi, Hai Phong and Ho Chi Minh City, Quang Ninh and Dong Nai.
Earlier, the General Department of Vietnam Customs organized the collection of written comments through seminars nationwide. After synthesizing the opinions of participating units, the General Department of Vietnam Customs has explained the comments and revised the draft Circular amending and supplementing Circular 38 / 2015 / TT-BTC.
In order to finalize the draft Circular before transferring the senior level, while ensuring the time for promulgation of the Circular on schedule, the General Department of Vietnam Customs has continued to conduct a final review of the draft revised circular.
According to the Deputy Director General of Vietnam Customs, Mr. Vu Ngoc Anh, the draft Circular amending and supplementing Circular 38/2015 / TT-BTC was built in the context where the Government, the Prime Minister directed State units for drastic solutions to reform administrative procedures, improve the investment environment and enhance national competitiveness. This is clearly reflected in the directives and resolutions of the Government and the Prime Minister, such as: Resolution 19 / NQ-CP, Resolution 35 / NQ-CP, Resolution 36a / NQ-CP; Decision 2026 / QD-TTg. Meanwhile, the Customs sector must still ensure the task of collecting State budget allocated by the National Assembly and the Ministry of Finance.
Therefore, the issue of policies related to Customs procedures, Customs inspection and supervision has ensured the facilitation of export and import activities, but it has also created legal basis to meet management requirements against policy loopholes in the performance of public affairs.
The Deputy Director General of Vietnam Customs, Mr. Vu Ngoc Anh has requested that the review of the draft Circular amending and supplementing this Circular 38/2015 / TT-BTC has been carried out in detail, avoiding overlapping conflicts between current regulations and the new circular.

Accordingly, many contents continue to be consulted for adjustment and finalization in this draft including: Customs inspection measures in the process of Customs procedures for exported and imported goods, regulations on Customs dossiers for exported and imported goods; Customs dossiers when carrying out Customs procedures; Customs declaration; registration and distribution of Customs declarations; additional Customs declaration; cancellation of Customs declaration; export and import license; results of specialized inspections; sampling and storage of exported and imported goods.
