Formulating decree closely following the spirit in the scheme on reforming specialised inspection

VCN – Implementing Decision 38/QĐ-TTg of the Prime Minister date January 12, 2021, the General Department of Vietnam Customs is working on the formulation of a draft decree stipulating the management mechanism, method, order, procedure of State inspection on quality and State inspection on food safety for imported goods as a basis for implementing the scheme.

At a recent working session of General Department of Vietnam Customs with units under Ministry of Finance, local customs authoritiess and representatives of some business associations, import – export enterprises, Deputy Director General of Vietnam Customs Mai Xuan Thanh requested the decree must closely follow principle as stated in the Decision 38/QĐ-TTg. Complying with the regulation of the Law Customs; product and goods quality; food safety; standards and technical regulations.

To follow directions and orientations of the Government and the Prime Minister over the years on comprehensive reform of the management and specialised inspection of imported goods. The decree carried the spirit of directing the substantive reform of specialised inspection of imported goods to facilitate enterprises, but must still ensure the efficiency of State management of line ministries on quality of imported goods, protection of people's health and lives, environmental protection, economic and national security.

The reasone is that this decree would be the basis for the implementation of the scheme on the reform of the model of quality inspection and food safety inspection for import goods, therefore, in the process of completing the formulation, there is a need for the participation of specific and detailed opinions which are close to the principles stated in Decision 38/QD-TTg of the concerned parties to advocate for the reform to be really put into practice.

Currently, a draft decree is under construction, including 36 articles, divided into six chapters, including: general provisions; regulations on order and procedures for quality inspection and food safety inspection of import goods at customs authority; regulations on order and procedures for quality inspection and food safety inspection of import goods at ministries and sectors; state management responsibilities for quality control; food safety inspection and organisation for deployment and terms of implementation.

According to the leader of the Customs Control and Supervision Department, the draft decree has a number of highlights such as: simplification of inspection procedures; uniformly apply inspection methods; check by item; publicity and transparency of information; connecting for information sharing; and importer's rights.

Currently, the draft decree is being finalised by the General Department of Vietnam Customs to collect comments of stakeholders before submitting it to leaders at all levels for promulgation.
