General Department of Customs solves problems in tax policies for Taiwanese businesses

Satisfactory answers to many questions

At the conference, the representatives of the Customs Control and Supervision Department and the Import and Export Tax Department under the General Department of Customs also gave answers to many questions from businesses related to tax policies and tax rates on import and export goods.

Regarding the questions on inspection of goods though a written notice of the advanced ruling of HS codes of goods issued, Director of Customs Control and Supervision Department Au Anh Tuan said: the document on advanced ruling of HS codes is valid for three years if imported goods are as the same as those registered with the customs agency. If the imported goods are not the same as the sample registered with the customs agency, the customs agency will conduct a re-inspection and correct the HS codes.

Also related to the HS code application for the aluminum ingot of Gold Well Co., Ltd., Mr. Le Manh Hung, Deputy Director of the Import and Export Tax Department, said that the HS codes of goods are determined should be based on nature, composition of actually imported goods and the list of imported and exported goods according to Circular 103/2015 / TT-BTC, Circular 14 on goods classification and analysis for quality inspection and Government’s Decree 122/2016 / ND-CP on the promulgation of the Import and Export Tariff.

Answering questions from businesses related to the declaration according to two criteria of quantity 1 and quantity 2. It takes time to transform from the quantity of imported goods of each item by unit in the list of imported and exported goods into the actual quantity of transactions on the customs declaration according to Official Letter No. 7203 / TCHQ-TXNK dated November 11, 2020. Mr. Au Anh Tuan said quantity criteria on the import declaration is not a new point which has been stated in Circular 38 and Circular 39.

However, the customs agency also takes note of businesses’ comments to review and consider guiding businesses in the document. It can be that the system automatically converts the quantity of the same units, the Customs agency will assist businesses in the conversion, but there may also be some cases where the conversion cannot be done.

In addition, the representatives of the Customs Control and Supervision Department and the Import-Export Tax Department disseminated new documents and notes on customs procedures as well as answered many questions related to tax policies and procedures for imported materials for processing by export processing businesses, procedures to open declaration for domestic consumption for imported materials for export processing and production of which orders are being canceled due to the Covid-19 pandemic.

Speaking at the conference, Mr. Tham Hien Du, Chairman of the Taiwan Trading Association in Vietnam,said he was very happy to attend this conference. This represented the continuous progress of Vietnam’s Government as well as the government's focus on foreign businesses, institutionalization and transparentregulations.

He hoped that conferences like this will take place regularly andannually to promptly solve problems of businesses about customs procedures and tax policies so that investors can understand the law and follow the law and will bemore interested in investing in Vietnam, helping the country become the top choice for foreign investors; and to build a good investment environment between Vietnamese and Taiwanese businesses.

Director of Customs Control and Supervision Department Au Anh Tuan said that, in 2020, despite the Covid-19 pandemic, Vietnam's import and export turnover still increased, of which two-way trade between Vietnam and Taiwan had a growth rate of about 20%. This result had a significant contribution from Taiwanese investors in Vietnam in general and in Binh Duong in particular.

He also hoped that the revision of Decrees and Circulars on policies, namely Decree 59, Decree 08 as well as other related circulars, would receive comments from Taiwanese business to improve the system of customs procedures, transparency and create a favorable investment environment for businesses in general and Taiwanese businesses in particular.
