How were fake documents of tens of thousands of tonnes of smuggled scrap made?

Making forged copy and original
On May 21, the People's Court of Ninh Binh Province opened a first instancetrial in the case of smuggling waste and plastic scrapwith volume up to tens of thousands of tonnes.
The four accused included Nguyen Duc Truong, Director of Duc Dat Import Export Trading Services Co., Ltd. (Ninh Binh); Nguyen Van Son, Director of Truong Thinh Package Production Private Enterprise (Ninh Binh); Duong Van Phuong, a worker of the import and export division of Truong Thinh Package Production Private Enterprise, and Pham Quoc Huy, a freelancer who runs an import and export service.
One of the key violations was that they made aforged notice of imported scrap shipment issued by the Department of Natural Resources and Environment of Ninh Binh province for inspection and customs clearance and “confirmation of deposit and blockade” issued by some banks to import scrap.
How were the forged documents made by the subjects?
According to the indictment, from May 23, 2016, Department of Natural Resources and Environment of Ninh Binh Province did not grant any notice of imported scrap shipments for inspection and customs clearance to Truong Thinh Package Production Private Enterprise.
Because the Department of Natural Resources and Environment of Ninh Binh Province did not grant anotice of imported scrap shipment for inspection and customs clearance, Nguyen Duc Truong informed Duong Van Phuong and Phuong said if the department did not issue the notice, they would make the “fake confirmation of deposit and blockade” of Techcombank.
Truong agreed and assigned Duong Van Phuong to make the fake documents.
Initially, Phuong made a forged copy by using a computer and creating software of the notice for each shipment and cutting and pasting the stamp and signature of leaders of Department of Natural Resources and Environment of Ninh Binh province. Then he printed on A4 paper and stamped the seal of the Truong Thinh Package Production Private Enterprise.
From the end of June to the beginning of July 2017, Phuong colluded with a group of people in Hai Phong to forge the "original" of the notice.
Specifically, after receiving the bill information sent by the shipping line via email, Phuong printed and sent the document via email to Le Anh Dung in Hai Phong to make the fake original of the noticeof imported scrap shipment for inspection and customs clearance issued by the Department of Natural Resources and Environment of Ninh Binh. Then, Phuong received these fake documents from Pham Minh Tuan to send to Huy via air.
For the copy confirmation of deposit and blockade issued by Techcombank, Phuong made the fake confirmation the same way as the copy of the notice. In case of using the original, Phuong will apply for confirmation from Techcombank at Gia Dinh Branch.
During investigation, all notices of imported scrap shipment for inspection and customs clearance granted by the Department of Natural Resources and Environment of Ninh Binh province to Truong Thinh Package Production Private Enterprise for importing scrap from May 20,2016 to the end of 2017 were fake notices.
With the trick of making fake documents, suspects imported tens of thousands of tonnes of scrap.
Earned billions of VND
The indictment of the Supreme People's Procuracy shows Nguyen Duc Truong and Pham Quoc Huy got great benefits from the scrap smuggling.
Specifically, Nguyen Duc Truong claimed he was paid about VND 1 million per container by Le Anh Dung, Pham Quoc Huy or other customers for using the scrap import license of the Truong Thinh Package Production Private Enterprise. Nguyen Duc Truong earned about VND 2.5 billion.
Pham Quoc Huy claimed that for customers that he introduced to Truong, he received a commission of VND 2.5 million per container.
For customers Nguyen Duc Truong hired Huy to provide service, Huy earned VND 500 per container.
The total number of goods Huy introduced to Truong was about 1,000 containers, equivalent to US$2.5 billion.
Meanwhile, although Nguyen Van Son wasthe Director of Truong Thinh Package Production Private Enterprise, and the activities are directly managed and performed by Nguyen Duc Truong.
As updated by Customs News, facing violations related to scrap imports, the General Department of Vietnam Customs has worked with competent forces, especially the Police force to strengthen handling. Based on investigation results, in 2018, the Customs prosecuted a smuggling case related to some businesses, includingDucDat Trading Services Import Export Co., Ltd and Truong Thinh Package Production Private Enterprise and transferred the file to police for further investigation and handling. Also, in 2018, the Investigation Police Authority under the Ministry of Public Security (C03) prosecuted the case, the accused and detained many related objects, including the four subjects. After finishing the investigation, the C03 transferred the file to the Supreme People's Procuracy proposing to prosecute the violators. On December 17, 2019, the Supreme People's Procuracy issued Indictment No. 02/CT-VKSNDTC-V3 prosecuting the four accused of smuggling, namely Nguyen Duc Truong, Nguyen Van Son, Duong Van Phuong and Pham Quoc Huy. |
