Implementing solutions to handle tax debts within the effective time limit

VCN - To enhance the efficiency of tax debt settlement following Resolution 94/2019/QH14, the General Department of Vietnam Customs requested local customs departments urgently focus on implementing solutions related to tax debt relief and cancellation of late payment fines and interest.

According to the General Department of Vietnam Customs (GDVC), on November 26, 2019, in the 8th session of the XIV National Assembly, Resolution 94/2019/QH1A on tax debt relief and cancellation of late payment fines and interest for insolvent taxpayers was passed. The Resolution took effect on July 1, 2020 and was implemented for three years.

Accordingly, as of February 2023, the time of debt settlement under Resolution 94/2019/QH14 is just over four months (ending on June 30, 2023). In order to enhance the efficiency of debt settlement, GDVC requested local customs departments to focus on identifying the right subjects to be handled in accordance with Resolution 94/2019/QH14.

From there, collecting, supplementing and completing the debt settlement dossier as prescribed in Circular 69/2020/TT-BTC; comparing and accurately determining the amount of tax relief and cancellation of late payment fines and interest following the provisions of Resolution 94/2019/QH14 and Circular 69/2020/TT-BTC.

At the same time, implementing debt relief and cancellation of late payment fines and interest following the order, procedures, dossiers and authority as specified in Resolution 94/2019/QH14 and Circular 69/2020/TT-BTC. Coordinating with competent authorities in verifying the operation status of the holding company when handling debts for branches, affiliated units, representative offices and business locations as prescribed in Circular 69/ 2020/TT-BTC on applications and procedures for debt settlement in accordance with Resolution 94/2019/QH14, Law on Enterprises and Law on Tax Administration 2019.

In addition, GDVC also suggested that local customs departments take advantage of the support of the Party Committees and People's Committees at all levels and actively coordinate with relevant agencies (tax authorities and business registration authority) to ensure the completion of debt settlement within the validity period of Resolution 94/2019/QH14.

For the dossiers falling under the handling authority of debt cancellation of the Chairman of the People's Committee of the province or city, customs departments of that province need to urgently complete the dossier and report it to the provincial People's Committee for consideration and approval before June 30, 2023.

For dossiers falling under the handling authority of the Director General of Vietnam Customs, Minister of Finance and the Prime Minister, local customs departments should urgently complete the dossier and send it to GDVC before March 15, 2023 in order to promptly submit it to competent authorities for appraisal and consideration for approval.

GDVC assigned directors of local customs departments to raise the sense of responsibility, and attach responsibility for debt settlement to each customs officer at the unit.

At the same time, directing relevant departments to closely coordinate with the debt management division to review and complete dossiers of debt relief and cancellation of late payment fines and interest.
