New advances in cutting down the specialized management procedures

Positive results
In the recent report of the working group of the Prime Minister assessing the performance of tasks assigned by the Government, the Prime Minister said that to date, the ministries submitted and issued 21 legal documents, reduced and simplified nearly 6,800/over 9,900 lines of goods subject to specialized inspection (equivalent to 68.2%, reaching 136.5%, exceeding 36.5% compared to the requirement of the Government and the Prime Minister, and 13% higher than the plan of the ministries) and 30 procedures (reaching 50% compared with the requirements of the Government and the Prime Minister).
Specifically, the Ministry of Labor, Invalids and Social Affairs simplified and cut 33/33 lines; the Ministry of Science and Technology simplified and cut 22/24 lines; the Ministry of Industry and Commerce simplified by cutting 402/702 lines; the Ministry of Construction simplified by cutting 33/64 lines; the Ministry of Transport simplified and cut 80/134 lines and 7 procedures; the Ministry of Natural Resources and Environment cut 38 out of 74 lines of goods; the Ministry of Culture, Sports and Tourism cut and simplified 51/171 lines and 9 out of 10 administrative procedures; the Ministry of Agriculture and Rural Development simplified by cutting 5,898 lines of goods; the Ministry of Health abolished 1 item with 5 rows for the field of food safety; 810 lines of the remaining 4 items have been applied in the form of reduced inspection (95% of shipments will not belong to specialized inspection).
As a result, according to the plan, 7 legal documents related to the reform of specialized inspection have still not been promulgated, which are under the responsibility of the Ministry of Natural Resources and Environment with 3 decrees (currently the Ministry submitted the Prime Minister); Ministry of Health with 1 circular, the Ministry of Agriculture and Rural Development with 2 circulars, and the Ministry of Public Security with 1 circular.
22 documents on business conditions have been submitted
On cutting down and simplifying the business conditions, according to the plan, the ministries and agencies with conditional business lines must elaborate, amend and supplement to submit to the competent authorities for promulgation 70 legal documents (19 laws, 51 decrees) to simplify and cut 3794/6,161 business conditions. Up to now, the ministries issued 22 legal documents (1 law and 21 decrees), reduced 3,004/6,141 business conditions (equivalent to 97% of the assigned target).
Specifically, the Ministry of Industry and Trade cut 675/1,216 business conditions, exceeding 5.5%; the Ministry of Health simplified and cut 1,343/1,871 business conditions, exceeding 21.78%; the Ministry of Construction cut 183/215 business conditions, exceeding 35.12%; the Ministry of Natural Resources and Environment simplified and cut 101/163 business conditions, exceeding 12%; the Ministry of Education and Training simplified by cutting 121/212 business conditions, exceeding 7.08%; the Ministry of Labor, Invalids and Social Affairs simplified, and reduced 60/112 business conditions, exceeding 3.57% and 75/85 administrative procedures; the Ministry of Agriculture and Rural Development simplified by cutting 172/345 business conditions, reaching 50%.
Some ministries such as the Ministry of Culture, Sports and Tourism simplified by cutting 63/122 business conditions, exceeding 1.6%; Ministry of Information and Communication simplified and cut 63/122 business conditions, exceeding 1.6%; The Ministry of Information and Communications simplified by cutting 26/385 business conditions, reaching 13%; the Ministry of Transport simplified and cut 243/570 business conditions, reaching 42.6%; the Justice Ministry cut and simplified 7/94 business conditions, reaching 7.45%; the State Bank simplified by cutting 27 business conditions.
Therefore, according to the assessment of the Prime Minister's Working Group, 48 legal documents (18 laws, 30 decrees) on cutting down and simplifying the business conditions have been not promulgated, belonging to the responsibility of ministries including the Ministry of Education and Training (2 laws); the Ministry of Information and Communication (4 decrees); the Ministry of Health (6 laws); the Ministry of Agriculture and Rural Development (2 laws); the Ministry of Transportation (13 decrees); the Ministry of Labor, War Invalids and Social Affairs (4 decrees); the Ministry of Science and Technology (1 decree); the Ministry of Culture, Sports and Tourism (1 Law); the Ministry of Police (1 decree); the Ministry of Justice (1 law); the Ministry of Natural Resources and Environment (1 decree); the Ministry of Finance (6 laws and 3 decrees); the Ministry of Defense (1 decree); the State Bank of Vietnam (1 decree).
The above results show that the drastic direction that the Government and the Prime Minister has carried out for the effective implementation of the assigned tasks of the ministries and branches for the reform of specialized operation by simplifying and cutting down business conditions, have made positive changes for the goods list of specialized management by reaching 136.5%, exceeding 36.5% compared to the target assigned by the Government and the Prime Minister and exceeding 13% over the plans of ministries.
However, according to the assessment of the Prime Minister's working group, there are still shortcomings for simplifying and cutting down business conditions. In particular, the linking of inspection results among the specialized management agencies and organizations has not been strengthened. Therefore, the method of risk management has not been applied widely, the test results have not been recognized in the analysis and evaluation for the information of enterprises, leading to the duplication of inspections for the same item, the same manufacturer, such that enterprises must be inspected every time, but the detection rate of the goods without meeting the quality requirements was very low (about 0.06% of total shipments inspected).
The number of procedures implemented on the National Single Window is low; The elaboration and submission of legal documents on simplification and reduction of business conditions are still slow and fail to ensure the progress required by the Government and the Prime Minister.
Some ministries have issued the documents to remove the list or change the inspection of goods under their management from the period of pre-clearance inspection to the period of customs post-clearance, but they still require the enterprises to submit the documents to the Customs to clear the goods.

For example, Circular No. 07/2017 TT-BKHCN dated 16/6/2017, amending and supplementing a number of articles of Circular 27/2012/TT-BKHCN of the Ministry of Science and Technology regulating the State inspection on the quality of imported goods under the management of the Ministry of Science and Technology; In addition, the list of goods of Group 2 of the Ministry of Science and Technology (Decision No. 3482/QD-BKHCN dated 8/12/2017) only regulates 21 lines of goods subject to quality inspection before customs clearance, the rest belong to the post-clearance inspection. However, under the provisions of Circular No. 07/2017/TT-BKHCN, enterprises must submit a registration for quality inspection of imported goods certified by the quality inspection agency for the goods subject to post-clearance quality inspection. The enterprise must submit a registration of quality inspection for imported goods with the certification of the above-mentioned quality inspection agency still drawing up the specialized inspection procedures for customs clearance. In Decision No. 1254/QD-TTg, the Prime Minister requested the study of the appropriate management mechanism, which did not require the enterprises to submit an inspection registration certified by the inspection agency for customs clearance.
