New regulations on the structure of Customs Departments in provinces and cities

Decision 1919 / QD-BTC regulates that the functions and status of Customs Departments in provinces and cities are under the General Department of Vietnam Customs, to assist the General Department to implement Customs administration, law enforcement on Customs and other provisions in the area of Customs in accordance with the law. The Customs Department has legal status, its own seal and may open an account at the State Treasury as stipulated by law.
Reduce the number of divisions under advisory units
The organizational structure of advisory units assisting the Directors of Customs Departments under Decision 1919 / QD-BTC includes:
For Hanoi Department of Customs, Ho Chi Minh City Department of Customs, Hai Phong Department of Customs, there are 9 divisions: Customs Supervision and Management Division; Export-Import Tariffs Division; Anti-Smuggling and Handling of Violations Division; Risk Management Division; Inspectorate Division; Organization Division; Finance and Administration Division; Office Division; and Information Technology Division.
For Customs Departments of provinces and cities such as Quang Ninh, Lang Son, Dong Nai, Binh Duong, Ba Ria-Vung Tau and Da Nang, there are 8 divisions: Customs Supervision and Management Division; Export-Import Tariffs Division; Anti-Smuggling and Handling of Violations Division; Risk Management Division; Organization and Inspectorate Division; Finance and Administration Division; Office Division; and Information Technology Division.
For Customs Departments of provinces such as An Giang, Quang Tri, Nghe An and Lao Cai, there are 5 divisions (previously 6 divisions): Operations Division; Anti-Smuggling and Handling of Violations Division; Organization and Inspectorate Division; Finance and Administration Division; and Office Division.
For Customs Departments of provinces and cities such as Bac Ninh, Cao Bang, Can Tho, Dong Thap, Long An, Ha Tinh and Tay Ninh, the number of divisions reduced from 5 to 4 divisions: Operations Division; Smuggling Prevention and Handling of Violations Division; Organization and Inspectorate Division; and Office Division.
Particularly, in Thanh Hoa Department of Customs, the number of divisions is reduced from 5 to 3 divisions: Operation Division; Organization and Inspectorate Division; and Office Division.
For Customs Departments of provinces and cities such as Binh Dinh and Kien Giang, there are only 3 divisions: Operations Division; Smuggling Prevention and Handling of Violations Division; and Office Division.
For Customs Departments of provinces and cities such as Ha Giang, Quang Ngai; Quang Binh, Dien Bien, Thua Thien Hue, Dak Lak, Gia Lai - Kon Tum, Quang Nam, Khanh Hoa, Binh Phuoc, Ca Mau, Ha Nam Ninh, there are only 2 divisions: Operations Division and Office Division.
The Director General of the General Department of Vietnam Customs shall define the functions and duties of every Customs Department.
Post-clearance audit forces and Customs control forces rearranged
Customs Branches at border gates, Post-clearance audit Branches, Customs Control Teams, and Drugs Prevention Teams under Customs Departments have dramatic changes.
For Post-clearance audit Branches, they must meet the requirements of new regulations of the Customs Act 2014, which is consistent with the goal of strengthening post-clearance audits from 2015 to 2020. Therefore, Decision 1919/QD-BTC stipulates that only 21 Customs Departments have Post-clearance audit Branches, including: Ba Ria-Vung Tau; Bac Ninh; Binh Duong; Binh Dinh; Can Tho; Da Nang; Dong Nai; Ha Tinh; Ha Noi; Hai Phong; HCM City; Lang Son; Lao Cai; Long An; Nghe An; Quang Nam; Quang Ninh; Quang Ngai; Quang Tri; Tay Ninh; and Thanh Hoa.
In addition, new regulations restructure and merge Smuggling Prevention and Handling of Violations Division and Customs control teams into one unit to centralize and strengthen Customs control forces.
Specifically, there are 22 Customs departments with Customs control forces, including: Thua Thien Hue; Quang Ngai; Quang Nam; Quang Binh; Lao Cai; Lang Son; Khanh Hoa; Ha Nam Ninh; Hai Phong; Ha Giang; Gia Lai, Kon Tum; Dong Thap; Dong Nai; Dak Lak; Can Tho; Cao Bang; Ca Mau; Binh Phuoc; Binh Dinh; Binh Duong; Bac Ninh; and Ba Ria Vung Tau. The remaning Customs Departments still have 2 separate units: Smuggling Prevention and Handling of Violations Division, and Customs control teams.

This decision takes effect after signature and replaces Decision No 1027/2010/QD-BTC of May 11, 2010 of the Minister of Finance stipulating the functions, duties and organizational structure of Customs Departments in provinces and cities and Decision 2053/QD-BTC of the Minister of Finance on amending and supplementing Decision No 1027/2010/QD-BTC on May 11, 2010.
