Accordingly, the import of machines, equipment and process lines which have been used must comply with regulations about import goods.
The Decision does not allow the imports of used machines, equipment and process lines which have been eliminated due to being out of production, low quality, causing environment pollution by the export countries; do not meet requirement about safety, energy saving and environmental production in accordance with regulation. Only import machines, equipment and process lines that directly serve the operation of enterprises in Vietnam can be imported.
This Decision sets some import criteria for used process lines such as: it is produced under standard appropriated to National Technical Regulations (QCVN) about safety, energy saving and environmental protection; in case there is no corresponding National Technical Regulations, it will comply with national Standards (TCVN) of Vietnam or national technical of G7 countries or Korea.
Regarding the remaining capacity or efficiency, used process lines must reach 85% or more of designed capacity; consumption of materials and energy should not exceed 15% of the design; and the technology of process lines should not belong to the list of prohibited and restricted transfers.
The decision also stipulates import criteria for used machinery and equipment as follows: Age of the equipment does not exceed 10 years; particularly, machinery and equipment in the field of mechanical engineering, wood production and processing, and paper and pulp production can have an age not exceeding 15-20 years.
Besides that, used machinery and equipment must be manufactured in accordance with the National Technical Regulations (QCVN) with regard to safety, energy saving and environmental protection; if there is no corresponding QCVN, then it will comply with national Standards (TCVN) of Vietnam or national technical of G7 countries and Korea.
Moreover, regarding the import dossier of used machines, equipment and process lines, enterprises must prepare dossiers including: copy of business registration certificate, inspection certificate, original certificate of the manufacturer of machinery and equipment about the year of manufacture and standard of machinery and equipment.
The decision requires customs authorities to carry out only customs clearance as prescribed when the import dossiers and documentation are complete, valid and meet requirements.
In addition, the Prime Minister's Decision also stipulates the order and procedures for importing used machinery and equipment in other related cases as well as the inspection of used machinery, equipment and process lines.
This decision will be valid from June 15.
