Planning Law: Abolished 296 product plans

According to the MPI, the Government issued Resolution No. 11 dated February 5, 2018 to assign specific tasks to ministries, branches and localities in the implementation of the Planning Law. After more than a year, the implementation of Resolution No. 11 has witnessed positive results.

Firstly, regarding legal documents on planning, the Government proposed to the National Assembly and the National Assembly’s Standing Committee to issue two laws and one ordinance to amend and supplement some articles of 52 laws and ordinances related to planning. Thus, if including the amendments and supplements in the Planning, 73 laws and ordinances related to planning have been amended.

At the same time, the Government issued Decree No. 37 on May 7, 2019 detailing the implementation of articles of the Planning Law and Decree No. 41, Decree No. 53 and Decree No. 56 guiding the implementation of the Law amending and supplementing some articles of 37 laws related to planning.

In addition, MPI issued Circular No. 08 dated 17 May, 2019 guiding the norms for planning activities and the Ministry of Finance issued Circular No. 113 dated November 15, 2018 regulating costs of planning.

Thus, the legal documents on planning have satisfied the management requirements of all levels and sectors and making plans for 2021-2030. The dissemination and training of contents related to the law on planning law have been implemented for ministries, sectors and localities.

Secondly, in making an plan for 2021-2030, the MPI has coordinated with ministries and sectors to propose to the Prime Minister to establish a National Planning Council to advise the Government and Prime Minister in directing the making of national comprehensive planning, national marine spatial planning, national land use planning and regional planning.

At the same time, the MPI proposed to the Prime Minister to assign tasks to ministries to make national sector planning and assign provincial People's Committees to make provincial planning. In addition, the MPI has reported to the Prime Minister the regional scheme as a basis for implementing regional planning.

The MPI said that, until now, the National Planning Council has held two meetings and concluded the direction on implementation of some tasks to submit to the Government for approval of the task of national comprehensive planning; national maritime spatial planning; national land use planning and regional planning.

Some ministries have developed and consulted relevant agencies for the task of making national sector planning. Some localities have developed the task of provincial planning for 2021-2030 and are submitting it for approval.

Thirdly, regarding the transition of planning, the MPI has coordinated with ministries, sectors and localities to review and summarize and submit to the Government for promulgation a list of plans which are integrated into national planning, regional and provincial planning and a list of invalid product plans under approving jurisdiction of the Prime Minister so that ministries, sectors and localities have grounds to abolish product plans in order to remove difficulties in investment, production and business.

Accordingly, so far, two ministries (Industry and Trade, Agriculture and Rural Development) have issued decisions to abolish 58 product plans and 17 localities have issued decisions to abolish 238 product plans.

At the same time, two Ministries (Construction, Planning and Investment) are studying and submitting to competent authorities for promulgating specialized conditions, standards and technical regulations to implement state management before the product plans are invalid.
