Preventing origin fraud for goods imported from China but with label “made in Vietnam” to trick consumers

Previously, the mass media reported that the trade fraud by labeling the origin of imported goods has increased. Accordingly, goods are made in China but then labelled “made in Vietnam”, with a barcode and address of a manufacturing enterprise in Vietnam to trick domestic consumers. These goods are mainly electronic products, clothes, cosmetics and footwear. Vietnamese traders order these goods in China and then import them into Vietnam.
To prevent this problem and protect domestic consumers, the General Department of Vietnam Customs has requested directors of municipal and provincial Customs departments tell their customs branches to strengthen the inspection and identifying of origin and label of imported goods in accordance with provisions of Decree No. 31/2018/ND-CP, Circular 38/2018/TT-BTC; the inspection process for goods origin issued by the General Department of Vietnam Customs and the Government's Decree No. 43/2017/ ND-CP and guiding documents of the Ministry of Finance and the General Department of Customs.
For goods imported from China, when checking the dossiers of the imported shipment and implementing physical inspection of goods , the Customs officer shall check specifically the name, HS code, origin, label of goods that must be consistent with the dossier of imported shipment and certificates of goods origin.
If detecting imported goods are labelled “made in Vietnam”, municipal and provincial Customs Departments shall verify. If there is a basis to identify the imported goods have fake details, depending on the violation, it will be handled according to criminal procedures or sanctioning of administrative violations according to Clause 2 of Article 13 Decree No. 185/2013/ ND-CP of the Government.
