Strengthen to inspect origin of import cars from ASEAN and India

Specifically, the General Department of Customs requested that when doing customs clearance for importing completed cars from ASEAN and India which apply preferential tariff rates, Customs units need to strengthen the origin inspection in accordance with the provisions of Circular 38/2015 / TT-BTC; the Circulars issued by the Ministry of Industry and Trade guiding C / O entitled to preferential tariff rates; Process of verification of origin that issued together with Decision No. 4286 / QD-TCHQ of the General Department of Customs and guidance documents the Ministry of Finance. In particular, the local Customs units should note the inspection of meeting the origin’s criteria that are applicable to import cars.
In the case that has suspicions related to the validity of a C / O, the declaration information about C/O or the actual origin of the imported goods, the provincial Customs Departments must send reports and related dossiers to General Department of Customs for verification. During the waiting time for verification results, the import goods shall not enjoy the preferential tariff rates but shall enjoy the MFN preferential tax rates.
Moreover, the signs that need to be considered regarding the validity of a C/O including: Signs of forged signature, C/O seal, mismatch between information on goods declaration on C/O and Customs dossiers, suspected origin criteria on C/O or actual inspection (if any) show origins on the goods is different than information on declarations, regulations about direct transportation.
