Can you tell us the specific action plan of the General Department of Vietnam Customs in the implementation of Resolution 35 to support and develop enterprises by 2020?

On the basis of the action program of the Ministry of Finance in the implementation of Resolution 35 (Decision No. 1239 / QD-BTC), the General Department of Vietnam Customs issued Decision No. 1907 / QD-GDC promulgating the action plan for Resolution 35.

Accordingly, Customs shall aggressively implement the action plan of the Ministry of Finance in the implementation of Resolution 19/2016 / NQ-CP of the Government on the tasks and major solutions to improve the business environment, enhancing national competitiveness from 2016 to 2017, further target to 2020; Resolution 36a / NQ-CP of the Government on e-Government; Administrative reform plans of the Ministry of Finance in the period 2016-2020. Also, Customs shall check the quality of the work force, civil servants including training and retraining of civil servants who haven’t met the requirements of professional operations.

Besides, in order to ensure the rights of businesses, the right to equal access to resources and opportunities for their businesses, Customs shall focus on the implementation of activities to review and propose amendments to the Customs regulations between different ministries and relevant agencies to streamline the procedures, time and cost of implementation. In particular, Customs shall propose the Prime Minister to put in place National Single Window (NSW) in the period 2016 - 2020; coordinate with the ministries related to legal documents in the implementation of NSW; consolidate and expand with the administrative procedures which are officially connected to NSW.

Aggressively implementing Decision No. 2026 / QD-TTg of the Prime Minister approving the solutions to improve the effectiveness and efficiency of specialized inspection activities for exports and imports. Specifically, Customs needs to collaborate with the ministries to revise the system of legal documents on specialized inspection; urge ministries to issue a full list of items in the direction of narrowing the amount of goods to apply specialized inspection, provide details of HS codes and promulgate national standards, technical regulations for goods of specialized inspection as a basis of checking the quality of goods.

In additon, Customs needs to continue implementing Resolution No. 41 / NQ-CP of the Government on strengthening activities against smuggling, trade fraud and counterfeit goods; perform assigned tasks according to Decision No. 2415 / QD-389 BCD389 of National Steering Committee, the Ministry of Finance in the implementation of Resolution No. 41 / NQ-CP; implement regulations on the professional measures of Customs control; advise the Ministry of Finance to issue Circulars regulating acts of smuggling, commercial fraud, counterfeiting in the implementation of Decision No 20/2016 / QD-TTg of the Prime Minister.

In your opinion, what should Customs do to perform Resolution 35 effectively?

In order to create favorable conditions for enterprises in import-export activities, leaders of the Ministry of Finance and the General Department of Vietnam Customs need to direct specific programs and specific action plans. In particular, we must clearly define objectives, requirements, tasks which need to be implemented, including the completion time, the chairing and coordination organs.

In order to implement effective programs and action plans, in my opinion, Customs should consider implementing the following tasks:

Timely disseminate the full contents of Resolution 35, the action programs of the Ministry of Finance and the action plan of the General Department of Vietnam Customs for civil servants and employees.

Shorten the time and ensure the convenience, not troubling the export activities of enterprises, suitable with the provisions of Customs legislation; reform of administrative procedures through the application of information technology with modern management methods, improve public service and ethics of civil servants and employees; strengthen the operations against smuggling, trade fraud and counterfeiting to ensure fresh and equal environment.

The departments and division assigned to preside over these projects are responsible for monitoring, accelerating and reviewing the situation, the results of implementation of assigned tasks in the Customs area; timely reporting to the General Department of Vietnam Customs about the difficulties and obstacles in the process of coordination; perform monthly reports in the implementation of Resolution 35 of the General Department of Vietnam Customs.

The departments and divisions assigned to draft legal documents on Customs should ensure the quality of the draft through the review of a comprehensive assessment of practical implementation; fully define the scope of regulation, the application objects; consult the business community;  assess the impact of the administrative procedures for the draft legal documents containing the administrative procedures prescribed by law, complying with the order, procedures and new rules of legal documents;

Local Customs departments should implement administrative reform tasks, apply with the provisions of the Customs law in resolving the administrative procedures, facilitate companies in import-export activities (full administrative procedures under the jurisdiction decision); promptly resolve difficulties and problems of enterprises; the procedures related to customs under the authority of the agencies and other organizations, guide businesses to know clearly; implement periodic dialogue with businesses, propaganda and provide information to businesses under regulations of the General Department of Vietnam Customs; timely inspect and recount the inadequacies of the customs legislation of the General Department of Vietnam Customs, etc ...
