On 2/2, the leader of Post Clearance Audit Customs Branch (Hai Phong Customs Department) said that, Regal Motor Cars Corp., has paid 7 billion VND out of total a tax debt of nearly 9 billion VND. "The company's representative committed in February to paying all outstanding tax debts," said the director of Post-Clearance Audit department.

As known, on 29/8/2017, Hai Phong Customs Department issued Decision No. 3330 / QD-HQHP regulating on listed tax of Regal Motor Cars Corp., for the amount of 7.35 billion VND and Announcement No. 10958/TB-HQHP informing on the late payment amount of nearly 1,504 billion VND. The reason is a re-determination of the price for calculating tax of imported goods by Regal Motor Cars Corp.

After the issuance of the above decisions and announcement, on 20/9/2017, Regal Motor Cars Corp., sent document No. 1909/2017 / CV-TXNK to Hai Phong Customs Department and the General Department of Vietnam Customs to express their compliance with the tax assessment decision by the Customs authorities. However, Regal Motor Cars Corp., said that due to difficulties in their business operation they proposed to implement a partial tax obligation and the remaining amount of tax would be paid gradually.

"Regal Motor Cars Corp., has a high level of law compliance, but the amount of tax is very large (nearly 9 billion VND), especially in the context of the company's serious revenue decline. Therefore, at this time Regal Motor Cars Corp., is unable to arrange financing to implement its tax obligations"- the reason was stated specifically in the document. After that, the Customs authorities agreed to allow this enterprise to pay tax gradually.

The settlement of the debt payment of Regal Motor Cars Corp., would be done in accordance with the provisions of Article 39 of Decree No. 83/2013 / ND-CP guiding the implementation of the Law on Tax Administration and the Law on Amendment to supplement a number of articles of the Law on Tax Administration. The dossiers and the competence for enterprise tax settlement would be implemented in accordance with Article 134 Circular No. 38/2015 / TT-BTC of the Ministry of Finance.

"In the early days of November in 2017, Regal Motor Cars Corp., signed a commitment with the Department to fulfill tax obligations (nearly 9 billion VND) in November, or at the end of December 2017. By the end of 2017, the company had only paid 7 billion VND and still owed nearly 2 billion VND. At present, the Customs Branch has taken drastic measures to postpone customs procedures for this enterprise according to the law," the leader of Post Clearance Audit Customs Branch said,

It is known that the Post Clearance Audit Customs Branch has some enterprises that have still not paid tax under the tax assessment decision of the Customs authorities. Notably, according to the findings, those enterprises have enough financial capacity but they have not complied with the decision despite the Post Clearance Audit Customs Branch having implemented many measures.
