Customs reviewing code of customs brokers that are expired

The General Department of Vietnam Customs has sent documents to provincial Customs Departments for implementing Circular 22/2019/TT-BTC amending and supplementing Circular 12/2015/TT-BTC on procedures for granting Certificate of professional skill on customs declaration; granting and revoking code of staff of customs brokers; order and procedures for recognition and operation of customs brokers (the Circular takes effect from July 1, 2019).

In particular, the General Department of Vietnam Customs requested departments study the contents specified in Circular 22/2019/TT-BTC; disseminate and deploy to units and customs officials to comply with regulations. In particular, there are some new points of the Circular which contain provisions relating to the management of customs brokers activities at department and customs branch level(specifically in the amended and supplemented contents of Article 5 and Article 7, Article 10, Article 13, Article 14 and Article 15). Guidance and timely removal of problems and difficulties for customs brokers to carry out customs procedures during the implementation of procedures are also important

Furthermore, the General Department of Vietnam Customs noted the units that through reviewing many cases of customs broker staff whose codes have expired but have not implemented the extension of codes according to regulations yet. Therefore, when checking dossiers and conducting physical inspection of goods, the customs units must ask customs declarants to present customs broker’s staff cards for checking and comparison.

When detecting cases where customs broker’s staff use a code which has expired for carrying out customs procedures, customs authority should report them to the General Department of Vietnam Customs for revoking staff codes as stipulated in Article 10 of Circular 12/2015/TT-BTC amending and supplementing in Circular 22/2019/TT-BTC.

The provincial customs authorities need to review and conduct physical inspection on the operation conditions of customs brokers in their management area. They must then report and propose to the General Department of Vietnam Customs to suspend and terminate the operation of customs brokers which are ineligible for operation or commit violations.
