Suggestion to revoke business registration certificates of enterprises owing debts

VCN – Many enterprises owing tax debts at An Giang Customs Department could have their business registration certificates revoked by authorities as suggested by An Giang Customs.

Those enterprises have incurred tax debts from many previous years, while some enterprises were no longer operating at the registered business address.

Typically, Ty Hung Construction and Trading Co., Ltd owed nearly VND250 million of tax debt. An Giang Customs Department has implemented many debt recovery measures but they were not effective. Currently, this business was no longer operating at the registered business address.

Thien Quy Joint Stock Company has owed VND117 million of tax debt since 2008. Through verifying at District 12 Tax Branch, the company is no longer operating at the registered business address.

Trung Hieu One Member Limited Liabilities Company has owed more than VND27 million of tax debt that was incurred at An Giang Customs Department since 2011. In 2012, this company was no longer operating at the registered business address.

Since 2012, An Giang Customs Department sent a request to the Planning and Investment Department of An Giang to revoke the business registration certificate, but they did not receive any response from that unit. In May 2018, An Giang Customs Department continued to send proposals, but they still have not received a response from the Planning and Investment Department of An Giang.

Nhut Toan Company has owed debt of more than VND44 million since 2007. An Giang Customs Department also sent a request to the People's Committee of Tan Chau Town, An Giang province, asking them to apply coercive measures by revoking the business registration certificate of this company in accordance with the Law on Tax Management.

Minh Thu Construction Co., Ltd., has owed more than VND80 million of tax debts since 2009. This company has been subject to coercive measure by the Hoc Mon Tax Branch via revoking the tax identification number, and also proposed the Planning and Investment Department of HCM City to apply coercive measure by revoking the business registration certificate.

Van Minh Import-Export Construction Joint Stock Company has owed more than VND50 million. However, through verifying at the Tax Branh of Go Vap District, Ho Chi Minh City, this business has fled the registered business address.

For the case that enterprises have fled from the business registration addresses, An Giang Customs Department has proposed to freeze the debts.

In addition, An Giang Customs Department also proposed to the General Department of Vietnam Customs to consider clearing tax debts for two cases of debt arising before July 1, 2007, with a total debt of over VND40 million.
