Through the results of initial investigation and verification, what are the violations related to Asanzo Group Joint Stock Company, Sir?

Through identification, verification, inspection and working at the company and referring to some documents, we initially identified some signs of violations by this company.

Firstly, the company showed signs of infringement of industrial property. According to the judgment of the High People's Court in Ho Chi Minh City, the Asanzo trademark belongs to another company.

However, some companies still do not comply with the court'sjudgement and continue to import and trade protected Asanzo products. This violates the provisions of the Intellectual Property Law.

Secondly, the company uses the phrase of “Japanese technology" in advertising and printing on product packaging.

The General Department of Vietnam Customs has verified and worked with foreign partners and with Sharp Company in Vietnam. Thereby, it confirmed that the technology transfer contract (signed between Asanzo Group Joint Stock Companyand Sharp-Roxy Hong Kong) is fake.

Thirdly, the company has shown signs of evasion of Value Added Tax and Special Consumption Tax.

According to the report at the interdisciplinary meeting (on October 28), 98 percent of the value of TV products, only 2 percent of the value from production at the company are labeled as made in Vietnam, is this true? After this incident, what legal loopholes need to be improved, Sir?

Provisions on goods origin for export goods are provided in the Government's Decree No. 31/2018/ND-CP. However, these provisions for consumer goods traded and circulated in the domestic market have not been specified. According to the Agreement of the World Trade Organisation (WTO), the rules of origin for exported and imported products shall not be lower than those for domestic consumption. Thus, in the future, when competent authorities develop specific provisions related to the origin of goods that are domestically manufactured and assembled and consumed in the domestic market, the rules of originshall be at least equivalent to the rules of origin of export and import goods.

Recently, information was released about partners of Asanzo Group Joint Stock Company no longer operating. What are the results of identification and investigation results by Customs, Sir?

Through the inspection and verification results, some enterprises that have business relations with Asanzo Group Joint Stock Company have signs of vacating their business addresses. These companies are involved in sales and purchase, and issued invoices that do not reflect the true nature of the business.
